Interview In Two Days

Yup, I've got two days to my interview...we're leaving Tuesday night for Memphis primarily because we celebrated our One-year anniversary on Sunday and my wife wants to treat the trip outta town like a vacation. :rolleyes:

Ahem...moving on....

I've got the following documents to prove co-habitation;

Her driver's license bearing my last name(and the old one bearing her maiden name).

Her social security card bearing my last name.

Marriage license

Marriage certificate

Joint account(maintained since November of last year)

leases(both old and new..we just extended it)

Health Insurance

Car insurance

Joint Tax Return for 2005

Registration on two cars bearing both our names.

Cell-Phone bills(Family plan)

E-mail correspondence before we married

Wedding & other pictures

**The other utility bills are in my name only. I don't know if that's a problem. Is the above enough?

Well, that's it...I'm probably forgetting something.

Then I've got other documents...

I was arrested for obstructing an officer (I basically challenged a ticket for wrong lane change).

I've got an affidavit and court-issued dispositions of the case (I was fined a 100 bucks in total).

That's my problem...I'm wondering if this is gonna land me in name-check or delay adjudication any further...I'm freaking out :eek:

Actually I also got an official opinion from the US department of state, stating that obstruction of justice does not constitute a crime involving moral turpitude but I don't wanna press the issue...last time I went smart-alecking, well I got arrested for obstruction of justice.

Uhm lemme see, I got the other stuff...birth certificates(for both)...passport...two months worth of paychecks(for my wife) and 7 months worth of paychecks(for me)...Letter of employment for my wife(she's the sponsor)... etc etc.

So yup...I'm heading for the dungeon...

Wish me luck :)

P.S: Any inputs concerning the arrest would be greatly appreciated.

Kevin.... In my view, you are set for an approval. The above documents are sufficient to prove the legitimacy and bona fide aspect of your relationship. So, with above, the adjudicating officer is going to be overwhelmed, but in a good way. Ensure you have 1 copies of some of the documents.

Utilities in your own name are irrelevant.

This is not a crime of moral turpitude. However, in the future, don't obstruct an officer, every time a civilian gets into a confrontation with a police officer, they will always lose. Police officers are seen as objective parties with no motive to lie, especially in traffic cases. For example, Scooter Libby is a classical example of what any form of obstructionism can do. If you had struck an officer, then your green-card changes could have been NIL or ZERO.

When was the opinion written? In most cases, these opinions are written by DOJ on behalf of State Dept in response to a case which was brought to court, which now necessitate guidelines.

Lastly, Kevin your "misunderstanding" with a police officer should not be a major concern. Just explain your case, remember, only if you are asked to explain this case. Don't volunteer anything that can blow you off.... :o
 
Thanks Al...I actually got the Officer's statement which states exactly what happened. I don't disagree with his statement except he misspelled my name.

I was talking about the US department of state Foreign Affairs manual volume 9 - Visas(see attachment)

Don't sweat it..You'll be fine. Traffic offences are not counted at all, and don't volunteer any information at all. Take the disposition with you, because if you were fingerprinted for his offense, they have the record right in their file. So if you were arrested and booked (fingerprinted), you must declare it, or else they will think you're concealing some material facts.

That's just how they works..best to be safe than to be sorry..

Tomorrow you'll be telling us "I'M APPROVED'
