My Theory of Approvals based on Transfer dates working

VA_LC_CASE,
It is surprising to see that TSC submitted the NC 2nd time ...
How did you confirm that there is a 2nd FBI Namecheck sent by TSC. Is it true for every case... (I wish they do the same for me and it gets cleared...)
Plz see my sig. for details... After FP2 , no LUD so far...
InfoPass today did not reveal much other than NC is still pending since apr 2005, which i already knew.
 
fixGC! I confirmed it with the INFOPASS.

THE Immigration Officer told me that my NC is still pending after some research she tod me that First one is still pending but the NC which is initiated by TSC was clear and my file is ready for adjudicated. I confirmed it with the Congressman John Kyle in PHOENIX.

IO also told me that TSC Initiated the NC for all the transfered cases. But senior people on this forum are questioning the validity of this. SO I am not sure wether the IO was correct or not on second NC.

But U r case should be adjudicated any time soon as these guys are going with the transfered date. This trAansfered date is based on your I-485 filing date.

Apparently they must have restarted the processing of the transferred cases from scratch, ignoring most or all of what was already done by VSC. That's why the transferred cases are taking so long.

va_lc_case, is very nice participant and sharing his experience of conversation with IO at INFOPASS schedule. We have no reason to doubt contents.

My Thoery

MD_ROCKVILLE,

I mentioned two things..

1) TSC requested FBI for Name CHeck on all the transfered cases whose name check was pending. FBI returned the results of these name check requests in very short time for most cases. This news was from an Imigration officer at INFOPASS. Thats why most of the transfered cases should be adjudicated pretty soon. And we are seeing the approvals even though there was long pause. But Atleast we are seeing some approvals.

2) TSC is processing transfered cases on the basis of transfer date. VSC transfered these cases based on the I 485 Filing date and EB2/3 category basis.

Looks like this theory is working.

Right now TSC reached on 03/09/2007. There were some cases still pending which are transfered before this date. but they are special cases or they are with Immigration Officers who are worth nothing.

I have gone through some of your recent posts here on this forum. Looks like you are in little bit different situation, your 140 is not yet approved and its not transfered to TSC along with u r 485.
My wild guess in your case is:
USCIS didn't have a strategy on what to do with the 485 cases whose 140 is not yet approved. So they are either trying to get all unapproved 140s here in TSC or may be they are working on a plan to complete all the 140 in VSC itself.
But once they decide of this issue, all of you guys should be good to go.

Again this is my thinking and not based on any solid information.

But definitely they transfered the cases based on the 485 notice/reciept dates along with the EB catagory and working on this order.

But my thinking may be completely wrong. These are just thoughts.
In either case TSC is working lot better than VSC. Or VSC holded all the cases so long for no reason and we are the people suffered. But in the end we(people interested in GC) all will be happy with Green Cards in Hand.

I am not sure why CSC/VSC held your case so long. But you wait for couple of more weeks and push it through your congressman/senator who ever are helpful. Also try for INFOPASS afer 30 days and try to push them if your case is with a lazy officer then when they send e-mail/whatever that guy might respond and process u r case.

If You are from Rest of the World(not India and CHINA) then you are done with this process man by tues day. Otherwise U should be done in June 1st week. I didn't see u r LUDs while writing my preivous posts.
I am 100% sure that you are out of this hell. Unless they are looking for some information or waiting for extened review I am not sure what this extended review is. But few people posted about this.

But I really hope that U get u r approval emils on Tuesday.

My 140 is already approved (pls. see my signature 7/2004) ---Its just that TSC officer could not find it when I called on Friday. She said it still in VSC and the officer will have to get it transferred over !!!!!!!!!!!!!!!!!!!!


Besides, what is the theory behind June 1st????

TSC is already approving cases beyond May 2001 (last bulletin) such as 10/2002 etc....!!!!

For India EB2 and EB3 ROW. EB3 India cases later than May 2001 have to wait until June.

And they're not going to approve every eligible person on June 1st or even in the month of June. My PD became current on May 1st and I'm still not approved yet. I expect most of the transferred cases will have to wait until at least 4 months after the transfer date (i.e July).
 
Abc,

Your LUD pattern shows that they are almost done with your case wating to push the approval button.

Latest visa bulletin is applicable from June 1st. But who knows how USCIS makes it applicable. As veterans mentioned that USCIS is consistant in its inconsistancy.
So theories are just to listen but reality is when USCIS sends your GC in the mail.

Thanks for saying that. I helped a lot of folks in 2004 ( before Jan 1, 2005 EB3 retro ) and then switched using AC21. Honestly I was not expecting a jump in VISA numbers but now it brings me back to "approval lane" on June 1. I do miss LOTS and LOTS of good friends with whom I shared good and bad times during 2003-2004 ! Guess what, someone always takes the baton :) good luck to all and hope it gets over for everyone soon ...
 
Sorry for not paying attention but according to your theory or the general feeling around this approval guesstimates, when should I expect my approval (considering name check is cleared)? June itself or June + 4 months or before or later?
 
Its been a long wait

Yeah, MD_Rockville, I remember you being on the site for a long long time. I guess we are in the same boat. Most of the active forum members from 2004 got approved before the retrogression on Jun 30, 2005. In my case, they approved the derivative (revoked a year later as primary not approved) while I missed the bus due to namecheck. Anyway, hope Jun 2007 brings us the long-awaited cheer. Do you think its a good idea to go for Infopass on Jun1 to find the status as my date would become current?
