I have approved 1-360 from my previous marriage. I receive a letter from immigration stating that my approved 1360 is subject to denial if I don’t provide them enough proof that my marriage was good faith marriage.

Now first question is why the immigration is asking for the marriage proof where I have applied the I360 by myself not on behalf of my previous wife?
What legally INS could do or I should do at this moment?

Also I have applied the I-130 and I-485 with me current wife and waiting for an interview, which would take another 12 months or so.

Should I tell ins to stop my previous case?

I would truly be thankful if someone can show me the right path.

Hi, INS does have the right to ask you for proof that your first marriage was real. If you refused to supply the requested information than your application will be denied and they might write that your first marriaged was faked. And then you would have big problems.

Just get all of your records from the first mairrge like things that show both of your names. Also you can have an immigration lawyer look at your paper work.

Which clearly states that A self-petition will also be denied if the self-petitioner re-marries before filing or after filing and before the self-petition is approved. Remarriage after the self-petition has been approved will not affect the validity of the approved I-360 self-petition

On Edit: Your post says that you have an approved I360 petition. In order to get this petition approved you need to convince the INS that you had married for the right reasons.

secondary to that.. If your I360 is approved you have an immediate visa available to adjust your status to a permanent resident.

It seems that this re-marriage of yours has INS worried about your intent.
