My RIR denied like a JOKE!

i got a RIR deny letter from Philadelphia in late Oct 2006,

But it looks like a joke, they said i am applying a CHEF position, but god, i applied for an ARCHITECT. When look closer, the attached page is copied directly from an sample template. That confused me: do they want to denial me, but attached wrong page; or they confused my name with a chef?

I rebutted. the online record shows "in process" rather than "denial". But i haven't got any formal reply yet.

one of my co-workers rebutted a year ago, still " in process".
what is going on with those #&#$%^@#&$%^??????????

it is totally sureal.
i don't know what is going on.
Totally confused. :confused:

shall i wait? or start a perm? the PD is so early that i just can't afford to loose.....

Your case in the the non-RIR queue. You have the option of converting the now Non-RIR case to RIR. Please see here and talk to your company lawyer.

On the other hand, a new PERM will provide a speedy approval but you will loose the PD - for a non-retrogressed country it does not make any difference. If you are from a retrogressed country file PERM only if it is possible to file it in EB2 and the existing LC is in EB3 only. Otherwise, it would not buy you anything other than peace of mind.

Why is it in TR queue with out any notification to my employer or lawyer? how long will take it to do finish TR?
How do i know if BEC started TR or not?

RIR-denied means the case is no longer considered as an RIR type. Your lawyer already received the notification letter - obviously this is not a denial (as per the case status). Proceed as per the notification letter.

The official compeltion date for all TR and RIR cases is still September 30, 2007.

the original letter says "This notice of finding is the Departments' statement of its intent to deny the application".

Does it mean that it is not an official denial?

if that is the case, what could i do with it?

That's an intent to deny and not a straight denial. It should instruct your lawyer for subsequent actions and consequences.
