My Name Check and Dowry case in India

Dear friends,

I did apply for my citizenship and finished my interview on September 12th, 2005. My application is pending due to delay in name check. Here is my story.

I was divorced in 2002 in US and my ex-wife went to India to unite with her boyfriend. She also took my 2 year son and moved beck to India. I have the custody order in my favor in US. Now my ex-wife has filed a dowry case in India and listed my name as wanted under Interpol database. The main reason for this is not to allow me to unite with my son.

Since my name check is pending I am certain my name may have matched while FBI is doing their background check. So far, I have not heard any thing from USCIS.

Has any one been in a situation like me? Will my application be denied because there is an arrest warrant on me in India?

I would appreciate any clarification on this issue from any one. I am also planning to go to India and fight the case. This may take minimum 3 years to finish and I might lose my green card status.

Any advise and guidence is greatly appreciated.
 
I would take action against your ex-wife for taking your child overseas when you have a custody order here. Though US authorities will not do much to bring your son back to America, it will definately alert the officials in India and you could show them that a false dowry case was filed by your ex-wife as a tactic to counter your parental rights given to you by a court in the US.

Hopefully, this mess will be cleared up before USCIS finds out about it.

The US may do something in this case if India and US has some sort of agreement in this area. You should contact the FBI and file an international parental kidnapping case against your ex-wife, the FBI takes this seriously and there a special unit in the FBI for this matter only ( Google it and check it out), also removing a child from the USA without his/her legal guardian permission is a federal crime that carries a sentence for up to 5yrs (or 7) in prison plus some penalties . Her name will be on the FBI watch list, plus there are many other ways with which you can cripple your wife and put pressure on her through the US embassy. I also recommend that you hire a lawyer in India to clear you name and even pay your wife what she deserves. But if you have custody of you child here, she is definitely in trouble....trust me. Things might even get worse for your wife if your son is an American citizen.

One last advice to my Indian friends: I do not know much about the Dowry situation in the Indian culture/law but in case of a divorce why cannot you just give your ex-wives what they are entitled to even though you think she does not deserve it, am sure it is not much with the conversion rate. As you can see things can get complicated if you just decode not to it.

Thats good advice. I won't be surprised though if the OP really took dowry. Dowry is rampant in India.
 
dingleberry i still cant figure out how god gave u brain as tiny as a berry yet forgot to fill it with sense.stop attacking the op.For you guys its allrite if a guy gets cought with patronizing prostitution and actually had a conviction....yet you wanna sentence another guy even before his trial....
gone are those days when dowry was rampant...
now do we keep reminding you guys how african americans were discriminated in america or do we remind you of how racist the germans are for trying to terminate jews?
every country has its problem's and every one knows its over...
indian women today are a model to the world.Another piece of advice:
high time you stop watching pbs and bbc.
