my & my son's cases approved, husband still pending

Hi,

My & my son's cases has been approved 09/30/04 approved, husband still pending

I485 EB2
RD 09/18/02
ND 10/18/02
1-st FP 11/22/02
2-d FP 08/10/04
3-d EAD approved 08/23/04 (second FP expired 09/23/04)
No RFE

Have a questions about husbands case - his message online still the same from 11/2002. Is it possible that his case will be approved by another officer?
I called to Nebraska today and had a stupid answer that they are doing February 2002 cases and we need to wait few more month

Congrats!

I assume your husband is your derivative. It could be that FBI has not cleared his name yet. Alternatively, his file could have gotten separated from yours. Let's hope this has not happened.
 
You should have told them right then and there that they are lying about the Feb2002 date, should have given your example to prove your point.

when your case had been approved?
do you have any explanation from your attorney?
did you called to INS?

derivative cases seem to be seperated from the primairy applicant more often these days. I'm not sure why USCIS is doing this, but its definitely a trend that I've noticed, even though it specificaly states in the I-485 Standard Operating Procedure NOT to seperate family members' cases.

My case is also similar, my 140/485 were approved concurrently on 09/13. Wife(derivative) got a second FP notice with new A#. She did her 2nd FP on 09/21 and LUD changed online to 09/22 - but no change in status. Her status is still as original i.e. 'Case was recd and it is taking 660 days to process....'.
Mine is CA - EB2 - CSC - Concurrent filing with Substitute labor.
No clue on what will happen with wife's case now. Any suggestions, guidance will be great.

p.s.: I got my I-551 stamped on 09/28.
 
What is "derivative" ?

Guys,

Can you please let me know what is "Derivative" ? How it is related with FBI ?

The primary applicant is the person who was sponsored by a company using an I-140. The children and spouse of the primary applicant are the derivative applicants, since their approval is based on the approval of the primary. If the primary is NOT approved, the derivative applicants will not be approved either.
