My Life Turned Upside Down by Wife!

FalseAlarm

Thank you all for taking the time to read this post and thanks in advance for any answers or guidance. I have been living in the States for more than 10 years, have received my undergraduate and masters degrees here and now have been working for a company for more than 5 years. My greencard application has been in process since 2001 and am possibly 4-5 months away finalization.

I got married about 3 years ago and my wife was also added to my application. We had serious marital problems initially and my wife was arrested roughly 2 years and 6 months ago for "domestic assault". In consideration of our greencard application, the judge gave her "suspended imposition" and her probation ended several months ago without any other incident.

Just as I was thinking that we sorted out our marital and other issues, my life came crashing down today as she was arrested for "petit larceny". Even though this was something that I would not have ever expected of a person her age and social status, I am now left with the possibility that she may be denied for her greencard.
I have a two year old daughter whom I love endlessly and I am left desperate by my wife's inconsiderate act of sheer stupidity. I have no idea what will happen to us or my daughter who is a citizen.

My questions at this point are:

1. Will she be denied for her greencard?
2. Is there a possibility that we may both be denied even though I absolutely had nothing to do with her act and have no similar thing in my background?

Thanks again for any answers and guidance.

you can get custody in court due to her record.

Maybe
2. Is there a possibility that we may both be denied even though I absolutely had nothing to do with her act and have no similar thing in my background?
NO, They can't deny you based on her actions.

FalseAlarm,
Your marriage life and immigration issues are seperate.
I am sorry to hear the details but this is what can be done :

a ) Hire a good criminal lawyer. For petite larceny case, it doesnt cost more than $800 to $2000. The case will most probably be over in 1 trip to the court. The defence lawyer can easily get the charges reduced to disorderly misconduct or something which has no impact on Green card processing.

Read this document carefully
http://www.nysda.org/NYSDA_Resource...ect/03_Immigration_Consequences_Checklist.pdf.

b) Your case is not affected by her immigration issues.
