That EB1 EB2 and EB3 will become current soon. That everyone will be able to file 485 and get EAD soon. That PERM will take only about a month(so I am applying for PERM labor).

Good guys. I waited 2 years to come to US and now I am glad that I did come now as the immigration rules have been relaxed.

Hoping to file my 485 atleast in May 2006 if everything goes well.
Lawyer also said that the house will pass and will be made into a law in two weeks.

Yes, we made it and there is bright future for all of us.

Patience is the winner. My friend who came in 2001 is still stuck. I feel sorry for him.

Optimistic

No offense to your lawyer but i think he is being overly optimistic.
The road to Bill S.1932 being passed is a long way off and it may not get thru the Senate-House conference.

We are all obviously hoping this gets passed but i would not base any plans on it for the time being.

THe lawyer is saying all this to make sure you do not leave the company and he gets his $$$ on time for processing fees.

Understand this : if 485 was so easy !! then so many folks would not be struggling to make things current !. I think all of you should contribute for writing to senator and congressman, the more we do , the better the chance..otherwise..u may have aPERM approval of 2005, ur friend may have 2001, and both of u will run out of Visa and head back with all the shattered dreams..

Let us do what is practical and not rely on some lawyere's smooth talk.

No offense meant.. I am surprised so many folks are so naive..it just takes u all one minute to look at s1932 section of forum to understand ground realities --- s1932 is under priority retrogression. Note All visas becoming current is a big dream, but some relief we will get if the bill passes !! and President Signs it !

And looks like you already bought those unhatched chickens.

No harm actually in filing for the PERM, go ahead there is really not much you can do at this time other than this.

On the other hand there actually is if you have been thinking pessimistically about retrogression. And that is to buy a 1997 Labor for $25K - $35K, and help push the PD's further back.

Actually its good to know that some lawyers are telling people to file PERM and not go for buying old labor's. But again when after 6 months the retrogression thing does not get better the employee would become restless and would think of leaving the company and that is when the lawyer will offer the old labor.

Its a visious circle/cycle and the only benifactors are the lawyers and employers.

Mine Lawer is talking the same.But i dont belive in any her word.I have mine own brain, and I can add numbers , and I can feel politics weather, which is bad for immigration.So she said , good deal: pay me, lets do it 140 and prepare for!!!!! 485 and ???? and later you will be waiting a while!!!! , so i asked her does she call 5 years of witing for applay for 485 a while????? So i understand that i have to have help myself.....and i am doing that.I willl merry sooooon.
By the way , it was she which push eb3 for me,becuse she wanted to show herself, as person which can help boss obtain cheap labour......I am rest of world, so if i had eb2, i could be current....but not she and mine boss push eb3, probably they suspect cut-off dates, and wanted to keep cheap labour forever.
And what they have now??? Nothing, becuse i will not pay anything more ever, and i will quit mine job soon.
 
Thanks a lot for your honest advice. If the bill passed the Senate why not in House? I am confused here and I am now becoming pessimestic.

I am hoping for the best. I thought they will only increase the H1s but they are going to increase the number of Green cards too.

But I heard in the Radio that some congressman is against immigration as it is replacing American workers. It is true to a certain extent but Oh God we should all get Green card before everyone realizes this.

I saw in this board last week people were happy when senate passed. Now you say it has a long way to go.

Bills have to be passed by both, senate and house. Then they have to be signed by the president who can veto them. After that, the respective services (e.g. USCIS) have a time period of 'rule making'. At times, the rules USCIS comes up with have the exact opposite effect of what the lawmakers intended. Law-making is a slow and tedious process, don't expect for anything to happen soon.

Your lawyer benefits financially from you FILING stuff, not actually from you getting a GC. He might be more optimistic because he is trying to get his fees from you or your employer.

Believe me, they have caught on to this. As things are right now, you won't get a GC for the next 5 years (if you are from retrogression land).

Let's calculate. Before you may file PERM you have to spend
30 days for job advertising (labor market test)
30 days for waiting period.

Also getting prevailing wage from SWA takes some time, however it can be combined with those 60 days.

Processing PERM takes up to 90 days, however some people have been waiting more that 3+ months and still haven't had any response from DOL.

So, don't be naive.

Let me give you my 2 bit suggestion.

I hope and wish your lawyer is right. But things are the same as he tells you. And Iam not going to repeat what others say here. My suggestion is the more you think, the more frustation you get. Apply your GC and forget it till your approval. This is personal experience. Concentrate that time and energy to some thing more fruitful like career, education, marriage, kids, investment, NFL ......... ( the list is endless )

By the way, they need to staple "SAINT" to GC approval cards from now on since a person who waits to get GC has proven to have patience and resilence of a saint. May be we take this matter to Vatican!!

I came here US in 98 Still No GC. I started my GC process in 2000 for what ever the reson Still I didn't get it. If you get it soon. That's weel and great.
 
My Lawyer sang same EB3 song

Accoridng to my experience no body should file EB3 if he/she has U.S Master's degree. My lawyer pushed me for EB3 while I was asking her for EB2. That time she told me that EB3 or EB2 does not matter for your country. Also she scared us that you have one in so called BEC in EB3 now if you file for EB2 then its a questionble situation. Now I got certified in PERM and still at the same situation after there years with my employer. Thanks to PERM because of it my salary went up.

The dum lawyer I everseen. I will not suggest any body to my lawyer every.

Only hope is CANADA

What should I do?

My Canadian immigration is almost ready. They are asking me for Permanent Residense Fee and then move to Canada.

But, I got my PERM LC approved recently and going to file for I-140. I am so confused if I should go for Can. Immi. or persue my GC.

God help us all

Being realistic, pessimistic or optimistic

I see a lot of people in these forums not very knowledgeable and some what pessimistic about everything. Dangerous combination!

We should hope for the best but be prepared for the worst. Please refrain from being pessimistic/ optimistic without any factual information.

I spoke with my lawyer, who believes this bill will become law in next few weeks. It has passed senate with a good majority.

Malik, I also received my Canadian immigration few months back. I think you should go to Canada and complete your landing process. It is a breeze and return within 30 days doesn't require a visa stamping. (Please verify from the border office you plan to cross) It was not a requirement when my wife and I went in March. Once you get you Canadian green card you have about 3 years before you must move to Canada in order to save your PR.
 
I agree with the above post. Don't be overly optimistic or pessimistic without the facts. It is true that retrogression relief has passed the Senate but by no means is a law or about to become a law..contrary to what a lot of people here have posted or what their lawyers might have them believe.
If you need confirmation of how things are in the Congress just check the Immigration Caucus in the Congress with 100 odd members in its ranks..and chaired by..who else but our good old friend Tom Tancredo. To give you an idea, check this link: I will post it in the S.1932 thread also.

I recently got a letter from my Congressman, who is a member of this Caucus by the way, that he is against any increase of immigration numbers.
Botton line, don't count your chickens before they are hatched. Just get on with life and do your bit to help end retrogression.
