My lawyer asks for last 3 years tax returns; Are they required ?

My previous employer is continuing my green card process and filing my 485. Lawyer requested for the tax returns for last 3 years and I only have W-2s. Do I have to send them ?

Any feedback greatly appreciated.
 
Some people say it\'s not required some say opposite. Enclsoe them

if you have any, other wise tell them you don\'t have. It doesn\'t cost much to make copies. Isn\'t it?
 
Well folks. Sometime it could be dangerous to give the tax return. Why?? Read..

Becuse some of our smart brother/ sister cheated while filing tax return just to get some extra money or lower the payment back to IRS. Now they are in trouble. They must have to correct the tax return. By GOD\'s shake if the INS officer little smart (he also file his own tax return and knows how to do...!!! you know what I mean) then you are screwed.

What\'s a tax return anyway? Is it just the W-2 form or the form you sent to IRS? Can we obtain a copy from IRS?

Your comment is just baseless! IRS reviews every tax return comparing all W2s 1094s etc for that SSN. If IRS didn\'t find any problem with any tax filing then there shold not be any problem from INS. IRS is far more superior and better system compared to INS. If some one has any problem with tax filings then they should fear to IRS not to INS!

W2s and Tax returns are used to find out (a) If taxes are filed in time, (b) If some one really worked for specified employer as per other documentation (c)Didn\'t work for any other employer without proper authorization etc. that\'s all.

Well PCee, if you cheat IRS, INS will catch you.

IRS doesnt care about your immigration status. So you can show extra dependent (SSN number which is very avialable in indian soceity)in tax return. But if INS officer see the descrepency in I-485 filing, you finish.

Another issue, lots of ppl shows business loss in tax return.. man.. fix it now. You cant do any business while on H-1B. So carefull ppl. You may not only get deported ...but also in jail for IRS fraud.
 
INS & IRS are two different Agencies

I think IRS and INS are two seperate differnt agencies.But they can
get and share files if they want to.I think you cannot add extra ssn
to add your extra dependent to claim some tax money,because ssn\'s are unique and cannot be duplicated,and IRS can easily figure out if you
misrepresent.

The only thing INS requests tax returns or w2\'s because to see that your family members will not be of any public charge.For this purpose
we may only include any of the following,Employers letter or last 3 pay stubs or bank statements or tax returns etc..

It is not mandatory to include tax returns but most of them attach to avoid any future rfe in your 485.I also know few people got approved
without enclosing tax returns.The INS only looks to verify that we are paying taxes promptly every year that we and our family will not
become any public charge.

This is only my thinking after reviewing lot of discussions and Not
any legal advice.
