My I-140 RFE

My experience letters were NOT on Company letter heads. So the BCIS was not able to validate my previous employment dates. The letter that I had sent were on normal paper, but was notoarized.

Has anyone had this RFE before?

This is something that I should be able to address in a 2 week timeframe. I am keeping my fingers crossed (What else can I do?).

At least this is not something serious, hopefully. Comments?

EB2 RIR
I-140, I-485 Concurrent, RD 10/17/03
2 EADs, 1 AP. Just applied the Second AP.
I-140 RFE ON 10/21/04.
 
What you need to do since USCIS wants letter on company letterhead, is to find the people who gave you the work experience affidavit and asked them to give that same affiavit on their current company letterhead. In this way USCIS can contact them at their company if they have any questions about your work experience. This seems to be an easy RFE. You should get approved in no time.
 
What I was planning to do is to request the folks who gave me those letters of recommendation prepare a new one on their company letter heads. The lawyer has said notarizing is not required.

Question: I am not ablet to get in touch with one person who gave me a letter of recommendation. Can I substitute him with an another person? Or do the new letteres on Company letterheads have to be exactly the same from the people who gave them earlier?

Please let me know.

What I did was got the letter(Mine was a skills letter and not a work experience letter, as I had no experience before joining my sponsoring employer) on university letterhead and got it notarized as well just to be on the safe side. Mine was in the form of a letter and not an affidavit. If you cannot find that person, you can substitute it with some else who worked for the same organization.
 
In fact my I am getting a letter from someone who was not working with me, but knew the fact that I was workin with a particular employer. Is that good enough. It has bee impossible to track my earlier colleagues.

Would this hurt?

Could you please share the exact wording of your RFE?

Did your friend leave any contact infomation on the previous letter (on the normail paper)?

The online status only gives a generic message that says that "on Oct 21 an RFe was issued.."The lawyer received the details, but did not tell me the exact wording. However this is what i got from the lawyer:

we received a Request for Evidence today from CIS asking for you to submit "acceptable letters of recommendation to show that you meet the requirements set forth in the ETA750". Specifically, CIS has stated that your letters of recommendation are not on company letterhead. In addition, those letters that are on letterhead are not detailed indicating the dates of employment from beginning to end.

Hi BeerDrinkingJoe,

My RFE was also dated on OCT 21st, they had asked for my tax return for 2002 and my company's tax return for 2002.

I have sent mine today to the company/lawyer - they said they'll respond to the RFE tomorrow.... Lets see what TSC comes up with.

Hi Swarna_bist,

since i didnt get the copy of the RFE - im not sure about the Office #, will try to get the detail from my employer/lawyer.
 
responded to RFE.

Atlast after a hectic follow up with my employer and lawyer, got them to respond to my RFE.

CIS recd the RFE response on nov 4th 2004 - let me keep my fingers crossed.

How long does it take after RFE?

Any activity on the RFE send to USCIS. How long does it take the TSC to take action on the application.
