My name is Annie Chu. I am in a big trouble, and I need your guys advice get back to U.S. as soon as possible.

My husband is a Chinese U.S. citizen. We met each other three years ago, and we have been married for more than one and a half years. I got my conditional GC this June.

Like all other married couples, sometimes, we argued. But overall, I thought our marriage was great and we loved each other. I didn’t sense anything wrong before I left U.S. on August 28, 2004. One thing I have to mention is that he convinced me not to bring my green card with me during this trip to China, so that I wouldn’t lose it. I trusted him what he said. In addition, he was going to meet me in China on Sep. 12 and bring the green card to me at that time.

However, I’d never ever foreseen that he would want to divorce me just after I left U.S. He sent me an email asking for a divorce three days after I arrived in China. I was so shocked when I received his email, and I am still shocked now. I don’t know what happened and why he wants to get divorced. I have called him many times, but he never answered the phone. He never replied my emails, either. His mother told me that he had already cancelled his trip to China.

Now, I am in a very difficult situation. Since I left green card at home, I can’t go back to U.S.

I feel that this whole thing is his conspiracy. It seems he had made his decision about the divorce even before I left U.S., and that’s why he intentionally asked me not to bring the green card with me. I feel that he’s taking advantage of U.S. immigration system. He must know that it would be difficult for me to get a visa or reapply for a green card while I am in China. Since I am not in U.S., it would be difficult to protect my interests during the divorce process.

This is devastating to me. I don’t understand why he treats me like this. I need to return to U.S. to 1. find out why 2. try to work on the marrage or 3. get what I deserve if we are getting a divorce. I really really need your help and your advice how I can get back to U.S. as soon as possible.

P.S. Will my conditional GC be no longer valid if divorce becomes final after a certain wait period ? How long the certain wait period will be ?
 
Varies from state to state, but if you were in CA, taking advantage of your immigration status like this comes under Domestic Violence, and you would be well advised to lodge a complaint with DA's office in your US residence locality (try emailing them).

Send a copy to US Consulate in China. You might qualify for 'battered spouse' to get a green card on your own.. (I dont think u need to be physically hurt to be battered).

i am really sorry to hear about that! i am not expert on this, but what i do know is that you can come back usa:

go to usa consulate in china, claim you lose green card (you need provide your card number, or immigration case number ...), they will check their system and issue you "travel document" to come back to usa. this is the NORMAL procedure to all green card holders who unfortunately lose their cards oversea, it should be VERY easy to get.

move on this QUICKLY before somebady changed your card stutas (but i doubt anybody can cancel your card at this moment)

Sorry to hear about your situation.
Dont you have your Passport Stamped ? If you still have that, you can re-enter the US without your Green Card.
 
Your note says that you got your conditional GC in June, which means that your passport would have been stamped sometime before 2 months. In that case your passport(with the stamp) would be good enough to travel to US.
Just act fast, since your husband might have tried to file for divorce etc., which might complicate matters.
