My Husband Status?

Hi I currently have H1 status, and my I-140/485 were filed for my husband and myself.

my husband used the EAD (associated with I-485) since 8/28/04. I wonder whether he can switch to H4 status if by any chance that i-140 and i-485 are denied? Is he going to be out of status? Hope this never happen...

if you don't abandon your H1 status - yes, he can fall back on H4.
