My Husband is on a B1/B2 vistor's visa

I am a US citizen and married my husband in 2007 when he first came to the US on a trip. He returned back to UK and he has been coming to the states every couple of mths for 2wks visit. I want to apply for him while he is here since we have a 4mths old son. I do not want my son to be away from his father and the distance is taking a string in our relationship. How do I go about applying for my husband while he is in the states w/o returning to India. Please advise...I am new here and cannot afford a lawayer...am not sure if I really need one.

Doesnt the USC need to have an established period of residence in a non US country in order for CP? I could be wrong, but as far as Im aware each country has its own rules (eg, to apply for CP in the UK, the USC must have ILR for 6 months).
The only route I see is to apply for an immigrant visa (CR1/IR1). Of course the husband can visit during its process, though he cannot stay while it is being processed (it seems to me like the husband is an Indian citizen living in the UK...though the visa interview can take place in the UK...theres no need to return to Indian....again, I could be misreading the OP). If there is intent at the POE for the husband to enter the US and stay, then it is immigration fraud. Therefore the only route I see forward is a spousal visa
