my husband has never worked

Please help me. I noticed as I was filling out the affidavit of support that it requests the sponsors proof of employment. My husband has never worked since he has been in school all this time and he has never filed taxes. What am i supposed to do? What box do i tick "Unemployed and retired since...."____ ? Please help me. i read about getting a co sponsor which i can will this be enough. Any advice is helpful, thankyou.

do me Favor and keep me updated with your case as my roomate is in the same case.he has a gf in india and wants to bring her in only problem is he has never worked and i want to be his co-sponsor...so plz keep me updated as how ur stuff works out...

Are you the one who is filing for the "Petition for Alien Relative" (I-130) for your husband or is it vice versa. That is not very clear here. The person who is filing I-130 for the other person should also fill out the Affidavit of support for the same person. If your income is not enough to support the 2 of you using the 125% of poverty line value, you can get a joint sponsor to fill out the same form too. But if you use people who are members of the same household, you have to fill out the form I-864A. In any of these case, you will need to send copies of w-2s and Income Tax returns for the last 3 years for all of these people. Also remember that when you have another person as a joint sponsor, the income you need to have goes up as the count of people also goes up.

There are three things I would like to address,

1. Have you filed taxes ? if yes have you filed jointly this year or not, if not you may ammend your taxes and file jointly with him. ( dont worry you will get your all money back if you married and hubby dosnt work :p )

2. Yes, you need a co-sponsor, that has a tax return that shows he/she made more than 15000 a year if there are only you and your hubby on the I-485.

3. Unemployed box may be the most appropiate (this is not legal advice) , however I would recommend that he print out his loans and grants from the College fin aid page that shows how he is living and paying for college. This will insure INS will not send you an RFE ( sometimes they do for students asking for this sheet)

Do you work yourself? Have you filed taxes?
You have to get a co-sponsor, and also submit any documentation which proves that you guys are above the poverty line. This is very important.
You have to persuade the INS that you as a couple in a OK financial standing and you hubby (or a co-sponsor in this case) is making enough money to support you.
Not sure about the box "unemployed and retired since...Ó
Also, put that your hubby is a full-time student in the ÒoccupationÓ question.

My husband is the sponsor and I am the benficiary. My family supports us both. He attends a GED course that is free so he does not have any financial aid or loans. I do not work as I am not legally able to do so and he has not been able to obtain a job as yet. On the affidavit of suport forms they ask for proof of current employment, he has none. My aunt is willing to be a co-sponsor for me since she is my primary source of income, but what should I do about my husband not working, what should i put on the forms. I read that I should write a letter explaining why he has not filed taxes which I can do but what about him not having proof of employment. Thanks for everyone's help so far.
 
Whoever co-sponsors has to show that they make enough to sponsor you as well as his family if any. So if John Doe will sponsor you and is married to Jane. He has to prove that he can support a household of three people. Unless they have kids...hope this makes sense.
You have to attach and explanation of why you did not file taxes. So a letter stating he has not worked hence did not need to file should be fine. I think if you list that is he not working then you don't need to prove anything. I would pick unemployed or retired since....as he is unemployed. Then if he has never filed for taxes you don't need to fill anything.
Just make sure your aunt makes enough to support her family and him.
