My Gc Timeline Make Sense?

I am working here under TN, and I am going to start my PERM application next month. I just want to make sure this is the right proceddures:


1) End of May: get prevailing wage

2) June 2006: place job work order, and recruitment (it takes around 3 to 4
months to get PERM approved). Can I change my TN to H1B at the same time (I heard H1B need ~3months). and also can I use PERM LC to apply H1B?

By the way after Oct, 2006, I can use 2007 H1B quota. Is that right? My TN is going to expire on Jun 2007. On the H1B application, can I write down the expecting start date any time after 01/01/07?

3) After get H1B (hopefully, it's in 45 days of PERM approved), so I get filed my I-140 and I-485?

Are those right steps to do my GC application?
Any comments and info are very welcome.

1) Sure.
2) You can apply for H-1B now. Your start date can not be more than 6 months away.

PERM LC and H-1B have nothing to do with each other - in your case.

3) Yes, you can apply for I-140/I-485 after your H-1B is approved if you are not from a retrogressed country.

For China

EB-2 is retrogressed to January 1, 2004.
EB-3 is retrogressed to May 1, 2001.

But I am a bit confused, if you have a TN, where are you from?

One can qualify for a TN by being a naturalized Canadian citizen, but as you know priority dates are determined by your country of birth.

So if I am canadian citizen born in India, I am still affected by Retrocrap?

I have seen before on this forum about Canadian Landed immigrant applying for EB2 and EB3 CP in Montreal...

Yes, you would be held to the priority dates given for India.

What does that have to do with your first question. One can apply at any consular office, but it would be inconvenient if say, you needed a tourist visa to get into the country where you wanted to do your consular interview. A Canadian landed immigrant can get into Canada without a tourist visa, so it would be convenient to go to Montreal rather than to travel back to one's home country.
