i am getting married to my US citizen fiance soon but she receives SSI, for something related to severe depression in the past. the problem is, she doesn't have any mental issues now but she continues to get this fund.
please tell me if you can spot any possible issue regarding this through the entire GC process.

So, your spouse is no longer suffering from depression, but he continues to cash the checks? If the checks should have stopped a while ago, then he is a thief and if caught, the law will deal with him in the manner appropriate. His stealing of public funds won't affect your green card, unless he has no job and depends on this check to support you, which will make him ineligible to sponsor you based on those funds. IMO, his immoral act won't affect your green card process, it is perfectly acceptable for US citizens to commit many crimes of moral consequences, but it doesn't affect their ability to sponsor an immigrant. Good luck.

my spouse intends to stop receiving the SSI. it wasn't meant to be "stealing" or anything, it's just like for things like mental depression, there is no clear line of being affected and not. but anyhow, i figured this wouldn't be a problem during the whole paperwork unless like you said, she is going to sponsor me (which she is not, i have a joint-sponsor who will fully support me and my spouse's income will be marked as "zero"). the only issue that i can foresee is during the interview, if the interviewer has her background info and asks about SSI.

USCIS cannot run a background check without consent of the individual, plus he's an American. For example, if he was a serial killer who served 10 years for triple murder, but fell in love with you, USCIS would still grant you the green card provided they are convinced that your marriage is legitimate. If the shoe was on the other foot, you an alien had his criminal record, you would have been deported on the same day of the interview....lol! If he's no longer suffering from mental depression (which is a great thing), then he can return those checks to SSA, but it is considered stealing if he continues to cash them and he's no longer suffering from the disease. I know it doesn't sound nice, but it is the truth.

Not true. The Adam Walsh child protection act restricts the ability of us citizens convicted of crimes against women and children to sponsor immediate relatives. This is why the petitioner now needs to file a g-325 and a background check is run.

TRC,

Show me where in my posts did I reference the serial killer having committed crimes against women and children? The serial killer could have killed waste removal people for all we know. The chances of USCIS running a background check on US citizen sound like a whole lot of who shot John, unlikely and maybe done on a small fraction of cases. Assuming the individual petition was indeed a serial killer, which part of our laws dictates whom we can marry and not marry, aren't serial killer part of our society? If the immigrant want a serial killer, so be it...

well, my spouse isn't a serial killer haha lol
anyhow, all i wanted to know was whether the interviewer could possibly have the info that the spouse gets SSI and asks questions such as "why do you get it?" "any supporting evidence?' etc
