My FP theory just flew out. Trust USCIS to be unpredictable. Just rcvd my FP notice to appear on 9/11. Spouse's has not yet come.

ND 140/485 : 09/22/03
140 RFE : Mid June 04
Replied RFE : 08/12/04
FP1 for 09/11

Yeppo

PS : My LUD or message has not changed on 485 since it was rcvd. No mail either on this.

The new theory is:

Just think of what you want.

Expect exactly the opposite from USCIS !!!

You are just like many others in this forum. No theory or pattern stays valid from USCIS actions.

BTW, what was your theory?

Any chance you might be getting FP due to the theory that nemessis came up with elsewhere: people at smaller service centers (ASC's) might get FP notices at more random times whereas people near large centers will be handled with bulk notices in a more predictable manner?

New FP Theory

OK, guys here is the new FP theory .. this one is just developing

1. Everyone is getting FP notice who has a ND before April 01, 2004.
2. Only the primary applicant is getting the notice (most cases).
3. The USCIS site is NOT getting updated with the FP notice.

I know of 5 other people in my company who received the FP notice on the same day (Thursday and Friday) but have 485 notice date varying from September 22, 2003 to mine (being the last) March 22, 2004

FP in Brooklyn office

Mine is even strange. My I-485 was transferred to NYC local office on Aug 2, 2004, but yesterday I received a letter for FP (scheduled on Sep. 2 in USCIS, Brooklyn, NY) from VSC. Inside the letter, in service center column says "ESC" (don't know what stands for). The problem is that I will go to vacation on Sep. 1, did anyone have experience of FP on Brooklyn office? I want to go there on Aug. 31 (two days before the schedule), I don't know if they do FP every weekday and if I will be allowed to do this ahead of time. Any comments are highly appreciated!

By the way, I just informed VSC of my address change at the mid of Aug via mail. Maybe this triggered something, I am not sure. However, my wife didn't receive her 2nd FP notice (I am the primary applicant), any comments?

Ah, no updates in the online message for the I-485, still something about the transfer, and last update date is still Aug.3, 2004.

Thanks!

How do you explain then the EB2 from July 2003 didn't get the FP yet (myself fo example, but I am not the only one, and I have the I-140 approved)? And I agree there are several ppl who got FP without updating the WEB site but there were 3 bulk FPs in Aug (6, 13 and 25) which were updated on the WEB site. There are 2 different things going on and you might be right for only one of them ... We've seen individual FPs for 2003 applicants months ago also, but again there were not bulk FPs (bulk = almost everybody, >80% of all the applications not just isolated cases). In the interval Sept 22 - March 22 you mention we don't see > 80% of applications getting FPs in the same way ppl with ND < July 10, 2003 got, so you cannot say that "Everyone is getting FP notice who has a ND before April 01, 2004" - there is no data to support your theory so far ... my theory proved to be innacurate also (regarding ASCs) so I don't think we have a close idea of how they send the FPs yet ...

"2. Only the primary applicant is getting the notice (most cases)." I am not sure about that either

"3. The USCIS site is NOT getting updated with the FP notice." - False ... they updated the Aug FP sent on the WEB site and this week lots of FP sent from Aug 6 are now Resumed ... so for bulk FPs they are updating for sure the online system

nemessis .. I know my theory has lot of loop holes .. unfortunately I do not have any data (did you notice the words "developing theory" :D )

Anyways, these are more like ideas thrown about for discussion based on what people are reporting on this group .. nothing more.

does ASC work on Saturdays

Yeppo.. 9/11/2004 is a Saturday... are you sure your FP scheduled on that date?.

Anway the devloping theory of "dazzling" has lots of grounds to develop further because i am one of the person where the theory holds true...

Yes it is on a saturday. In fact let me throw some more gems here

1) ASC Brooklyn works from Tue-Sat.
2) If there is a Monday which is a Holiday then they do not work on Saturday preceeding that.

I think Babus like politicians are same the world over. :)

Yeppo, I can't find you in the 2003 tracker. Did you make an entry for your case?

I am sorry my friend. I think not. remember I had an entry but I guess that was in NJ sesa forum. I will try to add it or else post it so somebody could add it.

I got my fingerprint done this morning. It was very smooth, I don't think that they checked the scheduled appointment date in the notice. I am somehow relieved now.
