I had the following experience with my Interim EAD application from Chicago BCIS.
I am from St. Louis and STL is not doing interim EAD's. So, i decided to try chicago instead. I frequent chicago and so i thought i can take leverage of that. My EAD is 90 days past due today.
I went at 5.30am and stood in a line. There were about 100 people in front of me. It started at 7am. Completed my security check by 7.30.
A lady called out,
=is anybody for work authorization renewals.
-I said Yes. She handed me a form with three pages. First was Index of contents. Cant remember what it is but its not important. Second page was some form G-28 (i think) and third was I-765. G-28 was simple, name, A#, address etc - basic information. Completed the forms and took it to a counter.
The lady there said,
=what are you here for.
-I-765 ren. i gave her my I-765 receipt and gave the form that i got.
=who gave u this.
-The lady upfront.
=U shouldnt be getting this. She asked another lady beside her, what is this form. That other lady said that is for students i think they are giving it for everybody.
=This lady(2 me) said u shouldnt be getting this form. Take this instead.
I took it and at a glance it was the same form the form G-28..
-This form is the same as the other one maam. I said.
=what let me see. Oh ok. then take that and drop it in a bin over there.
I saw a bin on to the far left which said "Walk In EADs". I dropped mine over there.
At 8.30 a lady called me.
=Give me your current EAD and I-765. I gave both the originals.
Didnt u bring a 765 copy for us. I gave her one.
= I will call u soon. I Went back to the bench.
=At 9.10, she called me back. She has a different expression on her face. You have a RFE on your I-485.
-ok.
=We cant give u an EAD if you have an RFE.
-Maam, EAD is for a pending I-485. Why will an RFE on a pending 485 be a reason for not giving EAD.
=I cant give u if you have a RFE.
-I saw my online status yesterday evening and i dont see RFE on the case. So how will i know and BTW, my RFE is on 485 so there should not be any problem with EAD. She looked at my papers one more time and after a few seconds her face lightened up.
=You are not from Illinois. and she started pulling out the staples and took the pages apart. Now it was my turn to take it.
-i come here very often so i am as good as in chicago. I can provide an doc's if u need. i tried a little bit harder.
=No we dont want to do the work for St. Louis office.
-I took out a document which says St. Louis office doesnt do EADs
and showed her that. Maam st. louis office also doesnt do EADs so i dont stand a chance there. Cant u consider that.
=You should take it up with the St. Louis office then. Not here.
-Then i tried my last weapon. I took an employer letter saying, i will be pulled out of payroll when my EAD expires. I showed her that and said, If u dont give me an EAD i will be pulled off the payroll and i dont think i deserve it as i filed my EAD much in advance.
=Show me an Illinois drivers license and i will give u you one.
-Then i tried to reason out a lot of things saying that i can bring proof that i frequent chicago often and all that. But then on it was like, how do i kick you out of here. She lost the argument with me, she seemed to soften a bit and asked me to go and take a seat and she would call me again.
After 15 mins she called me and said, the answer to you is 'NO'. i cant give an EAD. From now on the only thing coming out of her mouth was 'Show me an Illinois License'
I came out after some time. I didnt want to waste my time and her VALUABLE TIME as well.
