My employer is being investigated by DOL, how does that affect me?

Hello all,

I received a letter from Department of Labor (DOL) that my employer is being investigated for hourly wages and labor rights. I am on H1B visa with this employer. The letter says that want to interview me on phone or person.

How does this affect me?

My green card is being processed by this employer under EB3 and last week I have interview with the local office and the officer said your file looks strong and ready to be approved, once we have visa numbers we will approve it right away?

If they find him guilty or something in investigation what happens to my H1B and green card processing?

Please advice, I am getting very nervous, I think I have to call the DOL.

------------------Be honest with them and answer what they ask. If you don’t know anything then inform them that you don’t know about that.

How does this affect me?
----------------------If employer has violated H1B rule/regulation/law and kept H1 holders on Bench and the DOL has info then only employer can be fined if they find violations.

------------------ they can fine Employer not you as you did not have done anything wrong. If you submitted any fraudulent document at the time of H1 or at the time of LC or I-140 then you can face problems.
Please advice, I am getting very nervous, I think I have to call the DOL.

do you have I-140 approved?
do you have I-485 pending more than 180 days?

I have not given any fake documents during any stage of labor or 140. My 140 is approved, though I do not have a copy of that but I do have the receipt number and approval message from the case status online website.

Is there any chance my employer can revoke 140?

My 485 was filed in August 2007 (the July 2007 fiasco) so it has been filed and pending for more than 20 months, worst part is it is ready to be approved just waiting for visa number which I know will take forever from now on.

I just hope that this thing does not affect my H1 B status or more importantly the green card processing. I currently have EAD which expires in Oct 2010 (I am not using it though).
