> You probably are not aware that although an MS or BS+5 years experience to file
in the EB2 category is essential, it is not fundamental. The EB2 or EB3 catogary is more
to do with the job and a little less to do with your background. Your company has to first
classify the position as EB2 or EB3; that is, can a person with a BS degree do this job?
If he can, then it is an EB3 position. No, a master\'s is essential for the position, and the
minimum requirement to qualify for the position is an MS or BS+5 years, then the job
can be classified as an EB2. Next they look for the candidate and the candidate has to
have the requisite background, BS or MS. So just because you have a master\'s does
not automatically call for them to file an EB2; the job should be classified as such and
needs a minimum requirement of a masters.
Talk to your HR and if they can create a position for which, the requirement is only a
master\'s you may be able to then utilize your MS and apply under the EB2 category.
Remember, that for the RIR, EB3 is perhaps better at present since both EB2/EB3
presently have the same priority date (if you are from India). Then, your company is
saying to DOL that although our minimum requirement is only a BS, we are still unable
to fill this spot; and we\'ve found this very strong candidate with an MS who we are ready
to hire!!
So, unless you think the EB3 category will not remain current, my advise is to stay put!!
