My Company refuses to send my Original I-140 Approved Petetion.

I had a Problem with my company.
The Company lawyer refuses to send my Original
I-140 Approved Petetion & the Approved AP.
what should I do?

Is there a way I can call BCIS & Inform them?
Do I really need a Original Approved I-140 Petetion handy?
 
140 is supposed to belong to the company hence your lawyer won't send the originals to you.

But you can get the receipts from BCIS by filing FOIA!

Technically though you don't really need 140 receipts once your 140 is approved. All you need is your 485 receipt!

What does FOIA mean?

I have the I-485 Receipt faxed by my lawyer. If that's enough, then Iam Ok.

How about my Approved AP ???

As specified in one of the previous post 140 belongs to your employer so it may not be given to you.

But an AP is a travel document which should belong to you and you should get it if you need to travel. So you have every right to demand for approved AP from your attorney.

If you have not filed your 485 yet (or have not completed 180 days since filing 485) your employer may withdraw the approved 140 and can use the underlying labor for another employee.

If you have completed 180 days since filing 485, use G28 to file for change of attorney. You can either use the service of the attorney of your choice or represent yourself for all your pending cases. Once G28 is filed you can use FOIA to get every document (incl labor) USCIS received for your case.

Also, ask for original 485 receipt, you are entitled to it, and it is the most important document you will need if you switch jobs.

You should also have original AP and EAD! Sometimes they send AP to your lawyers office so the lawyer needs to send the originals back to you. It is essential to have them while travelling abroad. And EAD will be sent to your home address.
