Just got the fax from the lawyer. He received the Transfer notice from VSC.
The notice says "Preliminary processing of the above application or petition has been completed and it has been transferred to the INS office at Boston...... "

What does this suppose to mean ? Why my case has been transferred ? I am with the same employer who filed my GC, I 've never moved to different address after filing 485 ? Any gurus out there to shade some light on this.

Also, I am in the middle of switching company since I am getting better offer. Will this be problem ? Anyone was in this situation ?

Also, does anyone know how long it takes to schedule the interview at Boston office. Please reply..

Thanks in advance....

-----genearaly they transfer 5-10% cases to Local USCIS for Interview, nothing to worry

----- if you are changing company then take your new company future job offer letter and AC21 letter at the time of Interview

----- I dont know about much about Boston but it takes less time than NJ, NY, you will get Interview notice about 2 months before the Interview date, if you did FP 15 months back they will also send letter to you for second fingerprinting
Thanks in advance....

Your case is tranferred to local office for an interview. It happens to the majority of us, about the job change make sure and that you discuss it with your lawyer to see if it's okay first. They will ask you for a financial report from your new company if they find out about job change at interview that's what they did to me.

One more question, what is AC-21 letter ?

----- when you change employer you have to send 2 letters to USCIS with your I-485 reciept copy.
Is it any kind of form to download from USCIS website or any kind of formal letter ?
----No it is NOT form you need to do the below:
1 Your letter to USCIS with your name as on I-485 filing reciept and A#
you should state that you have changed your intent and would like to use AC21 and would like to work permanently with XYZ company after I-485 approval
2 letter from new employer that should state that we have future parmanent job offer for XYZ after I-485 approval. his job title is>>>>>> his skill set is........ (it should be same as on approved LC from past employer) if the USCIS asks for ability to pay from new employer it is better to send the company documents also.)

**** you can hire your lawyer he will draft AC21 letter and will mail it to local USCIS where your I-485 is pending or take the AC21 letter at the time of Interview
Do you have the format ?
-- I dont have but you can search the threads related to AC21

If so, could you pls post it..

Thanks in advance...

------ the letter posted on the above thread is not correct AC21 letter it is just employer letter that is submitted by employer when you fileI-485 or the USCIS asks for recent letter of Employer, when you file new letter from New employer to use AC21 then employer has to state that
1 XYZ will be employed permanent basis after I-485 approval
2 His Job title is/will be ...... and skilll ......... ( same as on approved LC by previous employer XYZ)

Ginnu

how about this one ?? I think this meets the requirements/format of AC21 letter

Can you let me know

Hi Ginnu,

I am so gratful for your important note here! I found this thread after read your advice on my own thread, which is also to do with AC21. The difference is that I already changed to a new employer 14 months ago WITHOUT telling USCIS. Based on your note, I am searching for AC21 format also...

Do you think I can use this format here? (both New Employer letter and Intent change letter from myself)?
Thanks, Ginnu,

----It is better to update USCIS so that they have info in your I-485 file that you need to use AC21, many say send it after RFE, I dont belive in RFE becase in RFE they ask many documents, better is to update sevice center with your copy of I-485 filing reciept+ your Intent change letter to use AC21+ new employer letter( as posted above)
Based on your note, I am searching for AC21 format also...
----Ithink the above sample is OK
Do you think I can use this format here?
---YES
(both New Employer letter and Intent change letter from myself)?

---YES
