My brother has Green Card, will that affect my H1 visa approval

Hi there,

I am on H-1 going for india in dec for stamping, I had to fill out some forms, in one of the forms DS-156 they ask me whether my brother is in U.S and under what status. I have my brother here on Green Card. I am worried disclosing that info might affect my H1 visa approval.

Does anyone have any experience in this regard. What do you think I should do.

I am leaving in four days to India, I have still not decided what to do.

DS156 is a common form for all applicants. A GC sibling will not be considered as immigration intent. Moreover H1 applicants are allowed to have immigration intent.
His GC will not affect your H1 approval.
 
What happens for F1

Jaxen/Jim/Anyone else,

If an individual's brother/sister has GC and the individual gets a F1 visa (Student) stamped in India by giving false info that he/she does not have a sibling in US with GC, what can be the repercussions for now or future.

In my earlier posting on this thread as I asked if the mis-representation/falsifying of facts on the form might have any repercussion? Your Answer was no.

So do you think that since the individual has already got the F1 visa with misrepesentation of the facts, it will not have any impact on him in future when the individual tries to changes statues from F1 to H1 or if the individaul ever thinks of immigrating to US. Or for any other situation that might arise in future?

Immigration intent is serious for F or B visa applicants. A sibling's GC status is not relevant for H or GC based on employment or GC based on a relation with a citizen.
Of course all opinions and situations are academic in this thread.
