Hi,
thought would share my experience for all the good folks on here. Maybe it will be helpful in your own situation.
- Company (very small...2 employees only) based in East coast but I live in California...company is a small time desi fu**ing sweat shop "consulting" firm..ya know we all have that experience.
- Only reason I joined the above company was because I got laid off and wanted to keep my H1 status in August 2001.
- Filed for labor in Jan 2002. Got my LC in 3 months!! (april 2002 approval)
- Concurrent filed for I140 and 485 in october 2002.
- Soon after filed for AP and EAD and got them in december 2002.
- Started working using my EAD in January 2003 for a different company
- Got my I140 approved in november 2003
- Nov 2004 case transferred to local office in california.
- Interviewed in January 2005.
- Did not get approved after the fu**ing interview.
- Got an approval notice from local office in april of 2005.
- Got stamping.
- Then my case got transferred from Vermont to CSC.
- finally got my emails today saying that card has been ordered..blah blah blah
Total time it took was 5 years (from august 2001 ..onset of new H1b to card ordered ).
More tidbits if you must know...
- I had a felony arrest against me back in the days. It was a pretty serious offense. But I won the case (yes that means found NOT GUILTY)...
- Never told INS about it...big fu**ing mistake...never lie on your 485. That is the reason it took another year or so for interview and crap like that.
- As soon as you file for 485, get EAD, AP and start working elsewhere if you don't like your job!!! It is perfectly legal (coming straight from an immigration officer). They don't give a rat's ass about where you work as long as you don't apply for friggin unemployement, welfare and pay your taxes.
- Quote from an immigration official who actually looks at the files beforing approving "we check for taxes that you paid last year, applied for any government benefits like welfare etc., and if they don't have any criminal records)...
- All this other BS that you hear or all legal mumbojumbo is nothing but BS and bunch of paranoid people wanting to make your life miserable...
Hope it helps...Read it at your own discretion. I just think apply for your GC, wait for EAD and faggatboutit.....It will come when it will come. No need to loose your sleep over it. INS does work, just slow or in weird way. But they will finally approve everyone as long as you don't kill someone!!!
