Must concurrent filing be exactly on the same day?

Hi,

I filed my I-140 in December 2003, and I-485 in March 2004. I have received receipt for I-140, but clearly it has not been approved when I-485 is filed.

Does this count as "concurrent" filing? Or is it sequential? or is it something in between?

My case is also same as yours. My I-140 (EB2) has got filed on december 1st 2003 and I-485 has got filed on march 23rd 2004. I don't know whether my case falls under "Concurrent" or "Sequential" or others. I have seen people filed I-485 at the same time as mine are getting FP notices. So I am assuming mine is not considered as "CONCURRENT", otherwise I should have received the FP notice by this time.


Please let me know if you have any other thoughts.

I haven't got anything else other than receipts so far.

Strangely, when I logged into my USCIS account to
look at my I-140 status (just for kicks as I know it
will take 360 days, at least), it says there was an update on
4/14. However, the message remains the one about receiving
the application and it takes 360 days blah blah blah.
 
I also filed I-140 only on 10/10/2003.
The website is showing that my case was last updated on 4/14/2004.

But, there is no visible change in status etc.
Maybe, they are showing updates on 4/14 for every case without really doing anything :(

Hi dasbabu,
I have checked the online status on the BCIS web site. The last updated date for my I-140 is set to "04/14/2004", but there is no change in my case. I think this is something the BCIS had done to all pending I-140 cases. Let us wait and see.

I received my FP notice somewhere in last week of 03/04. I got the FP done on 04/22. Today my I-485 status says that FP result was received and case is resumed for further processing.

Even my case status is the same as your's. I have a q though. Does this mean that our FP have been reviewed by FBI or they r on the way to be reviewed by them. Thanks.

I think they change the status after getting the FBI review. I am not sure though.

I don't think I got an answer to my generic question: must concurrent filing be exactly done on the same day? Is a 3 month gap still considered concurrent given I-140 is still pending?

I think even though you have filed 485 after a gap from 140, it is still considered as Concurrent filing. That is just my opinion.

Jist of the article regarding concrrency rules is:

Concurrent filing also allows for the I-485 to be filed after a receipt is issued for the I-140 immigrant visa petition. For purposes of ease, we refer to this as a “catch up” concurrent. When both applications are physically filed at the same time, we refer to this as “pure” concurrent.
