Does anyone have CR-1 visa interview at mumbai consulate in February? I have been checking the the web-site for the schedule and it still shows the January 2005 appointments. My file got there in late December and I still have not received the packet 4.

What else can I do to find the status of my case? I appreciate your help.
 
They usually respond pretty well to e-mail inquiries, so try sending an e-mail. You can also try your luck by calling them.

I have sent them 3 e-mails already. No replay yet. I haven't tried to call them so far. Calling them might be the only answer now.

I am getting worried now. My file was forwarded to mumbai in December. I haven't received my packet 4 with interview date yet. They have not updated the interview schedule on the web-site. What if my interview is in the first couple of weeks of February and my wife misses the interview because we do not know the date?

If the file is transferred to the Consulate during the last weeks of December, the chances of a Feb interview are slim.

Even if the inetrview is in Feb, the consulates normally send out P4 about 3-5weeks before the interview date. You can check the previous time lines in cptracker.com. But it doesnt hurt to call them and find out.
 
My case was forwarded to the mumbai consulate on the 15th of December. Assuming the christmas and new year holidays slowing things down, my case probably reached mumbai in the last week of December or early January.

Today is the 27th of January. Almost 4 weeks have passed since the mumbai consulate received my case. What is the realistic time frame for my interview date? Late Feb, March, or April?

My case was sent to Mumbai on 29th Sept. and I got my P4 in 3rd week of Nov. and my interview was in 3rd week of Dec.
As Vu2vut has mentioned earlier, generally one should receive P4 4-5 week in advance. I don't think your interview will be in February, so take it easy.
 
It is very strange that they have not updated the interview schedule on their web-site. I am wondering if they are aware of this.

1) how much time did it take you to receive the interview invite at the consulate after you filed for I-140?
2) i want to apply for CP becoz i have heard the process is faster but my concern is that i once over stayed in the US for 100 days past the I-94 date inadvertently. but later i was able to get my new visa without any issues. do you think its advisable for me to thru the CP process or should i opt for I-485 AOS?

I filed for I-140 in April and I got my GC in December, so it took me 8 months.
If I was you I would talk to a good attorney before I file for CP. I think in CP they do look at visas & entry-exit dates more closely, since in my case the consulor spent lot of time looking at my previous visas.

thanks for your input. but does the consular officer have a list of dates when i came into or left the US? usually they would know if they keep track of the I-94's when anyone is leaving the country but i have seen with my own eyes the airline staff throwing away the I-94's. so my question is how would they know when i left the country?
my visa was still valid but my I-94 had expired...becoz i didn;t closely look at the expiry date of my I-94 so i overstayed about 100 days. also if the consular officer knew that i overstayed how come i never had a problem when i just got my new H1B visa?

I don't know what airlines folks are suppose to do with I-94s but just like you I have seen them to be very careless with I-94s. All I was trying to say was talk to your attorney and make sure that there won't be any problem. Otherwise unless you have a valid visa stampped on your PP it would be difficult for you to return in case if any problem arises during CP.
And if one has to find out Exit dates all he has to do is look at PP for Indian Date of Entry. So consular can easily determine when you left US, and they already have all I-94 expiry dates for you with them.

Thanks Ram. I believe you're correct. If the consular officer really tries to look at my entry - exit dates and then compare it to the I-94 dates, then yes i would get into trouble. And in that case I dont think it'll matter if its 485 or CP. my lawyer thinks it shouldn't be a problem because the INS officer incorrectly stamped a wrong date on my i-94 that did not match with my visa validation date. unfortunately, now i am the one suffering.

If you proceed with 485, you will be inside US and will have access to an attorney (and possibly can fight the case), in the event USCIS finds out the disparity in I-94 dates. During CP, your access to proper legal procedures in highly limited.

I dont know about the validity of argument that the INS officer stamped the 'wrong' date. In many cases INS officer decides your allowed period of stay inside US and the VISA is merely an application for entry into US.

Please confer with a competent lawyer before your decide.

i am enclosing a letter that i had written to the US consulate in Mumbai for securing a new visa recently. I got my new visa re-issued without any problems, I wasnt asked any question by the consular officer. But do you think the consulate will look at my entry-exit date more closely during the CP process. Please advise?
Also, as soon as my lawyer had found out that I had overstayed he sent me back to india to get a new visa. I was told by the VFS people in B'bay that as long as I didn't overstay more than 180 days I would be OK but its hard to take their word for it.

Here's my letter to the US Consulate in Mumbai -
I have been working with ABC company since July 1999. I was issued my first H1-B visa valid from March 2000 to March 2003. In September 2001, while working in the U.S. in valid H-1B status, I was assigned a new position as a Product Development Engineer for ABC Company in Nashville, TN. A new H-1B petition was filed with BCIS and I was issued a new I-797A form confirming my temporary employment from September 2001 to May 2004 with the company. Upon entering the United States back from vacation in January 2003, I was inadvertently issued an I-94 with an expiration date of March 2003 (based upon the expiration date of my old H-1B visa) instead of the expiration date per the new I-747A form. During my entry I presented my passport and my new I-797A approval notice. As a result of this error, my I-94 card expired in March 2003, while I was present in the U.S.

While preparing documents for a revalidation of my visa, my company’s lawyers noticed the error and alerted me to the fact that my I-94 card had expired. I immediately departed the US to rectify the problem. Therefore, I am applying to the US Consulate in Mumbai for an issuance of a new H1-B visa based on my new I-747A form, valid from September 2001 to May 2004.

Do you think I was wrong here? Is this going to be a serious case considering that I did not overstay more than 180 days(which I know is a big problem)

It is impossible to speculate what the Consular officers would decide.
