Multiple TN's but only 1 listed on the current I-94

I'm a Canadian citizen working in San Diego. I've had a part-time job with Company A for the last 6 months, on a TN status. I got a full-time job 3 months ago with Company B, and when I applied for the second TN they took my old I-94 and replaced it. When I asked them to write the names of both Company A and Company B on the new I-94 and my passport, they said it didn't matter what was written on the I-94 itself and that on the computer I was still listed as having 2 valid TN visas. In the end they just listed Company B on the I-94 card and the stamp in my passport.

My big problem now is that I just lost my job with Company B. I'm still working for Company A, and there's a page on my passport that has that information on it. But the most recent stamp in my passport only lists Company B. I'm going back to Canada over the Christmas holidays, and I'm worried that when I try to cross back into the US they're going to stop me because I no longer work for Company B and that's all that's listed on the I-94.

Do I need to get a new I-94 before I go back to Canada? If I don't, what kind of documentation should I bring along? The original letter of employment from Company A?

Thanks for everyone's help, I really appreciate it.

You should have kept both I-94s. What the computer says is small comfort for your other employer, who has no proof that you are in status with him.

When you cross back, simply ask for new I-94 (not new TN) listing Company A, bring proof of employment -- and ask then to look in their famous computer. You don't need to present the old I-94 (although it isn't much good anymore is it), just give him the number of the one you got with Company A (you of course have a photocopy of that original I-94, right? You have been diligent enough to do this, right?).

Thanks for the quick reply. I do have a copy of Company A's I-94. Not because I was particularly dilligent, but because I had to email it to Company A after I got it. I'll definitely bring it with me, along with the original letter of employment. Actually, I'll bring everything with me (transcript, diploma, etc), and I'll even try to get a new letter of employment just in case I end up having to reapply.

I would have liked to have kept both I-94s, and there was actually a short discussion between INS agents as to whether or not I could. But in the end the supervisor said no, I could only have a single I-94 at a time and that was that. The reasoning was that since the I-94 is an arrival/departure record, having two of them would mean I had arrived twice without ever leaving. I couldn't argue with that, and wouldn't have argued anyway. I've seen people argue with the INS, and it NEVER goes well.

Thanks again for the advice.

You'e right about the not arguing part.

But if they truly felt that ou should only have the one I-94, they should have noted the 2 sponsors on the one they left you with

Of course, they didn't know quite what to do, and pointing this out to them would not be wise....
