Multiple I 485\'s

Has anybody ever filed multiple I 485 petitions? Does INS allow two pending I 485\'s for the same beneficiary? I filed an I 485 with my husband based on his approved I-140. His company is not doing very well under the current economic condition. My I 140 has recently been approved and I am considering filing another I 485 based on my own I 140 so that we would have a backup plan. Thanks!
 
Don\'t File Twice

No point - you\'re just giving the INS and your attorney more money. If there is a problem with your husband\'s employment, send a letter to the INS amending your I-485, substituting your I-140 for your husband\'s. Just sit tight for now.

Thanks for the reply. Do you know if anybody ever did this, i.e. amending the I 485 and substituting a new I 140 for the other. This would be perfect if it will work because my husband\'s I 485 has been pending for 3 months now. My concern is the INS will not let me keep the original cases because I did not have my approved I 140 at the time we filed 3 months ago. It would be devastating if we have to start from scratch and re-file based on my I 140. Thanks!

I believe I-485 would get rejected once anyone files both CP & 485. Earlier, law used to permit to have both, not now. I have seen on this board, people got rejected because of this. Please consult with the lawyer before going ahead.
 
You can file both

Last week or so, Sheela murthy has sent an email mentioning that a person can file 2 I-485 with your similar situation. i.e one for your self and another based on derivative status of your wife/husband.

However it is not possible to file 2 I-485 from two different companies as a primary applicant.

Absolutely you can file two or more

No matter how many you file, you will get one A#. It seems to me that you don\'t get much benefit by filing more than one.
 
Multiple 485

I alos saw Sheela Murthy\'s reply. However whne I discussed with my attorney for my case (ond as Primary and second My wife as a Primary) ,he showed me a provision that INS can reject both. Normally they are lenient. I do not want to take a chance after waiting for so many years. If first one falls thru\' then the second one can be used.
