MULTIPLE I 140 FILERS question

Question for multiple I-140 filers.


A) Appilcant had I140&485 filed based on Sub.LC.in CSC.
with Job 1 and salary X.

B) Original Labor approved for JOB 2,salary Y,for the appliacnt under NSC area now,applied by future employer,specifying experience mentioning related to only for Job 2.
(Only this part experince certificates attached as per job 2)

Candidate has qualifications& experience for both JOB 1 and 2.
For case A) total experience was shown where as only relevant part was submitted for Job2 at that time.
Job 1 and Job 2 are in related areas.
Job 1 salry is more than 20K than job 2.

Now future employer is intending that he will be filing I140(Job2).
But question for applicant here is,
In I140,there is a column asking deatils of prior immigration filed.

In case B),if it has to be filed,for above column,it need to be mentioned about Case A.
As Case B) is having lower salary and was mentinoned a part of experience of case A) only in LC,now if I140 is to be filed

1)will create in any problem/conflict for case A) which is already filed?
2)Will there be adverse affect on both?

Any detailed thoughts/experience/advise are appreciated and will be of help to the candidate.

******* Dear,No time to read your many concerns in short if company A filed I-140 I-485 and is pending no problem. Company B can also file I-140 for you or I-140 and I-485 for you. Nothing is illegal if you have two I-140 or two I-485 pending based on different employers LC, at later stage see what I-485 comes first or you can substitute your new I-140 with pending I-485 that has earlier PD

Recently i had chat with my attorney why he told not to apply two I-485. His explanation was in filing I-485 you are promising some one that i will join his company once I-485 is approved. It is like two persons standing in room promising that employee will join the employer and employer will have the employment ready for him. If you are applying two I-485 you are breaching the trust at least at one place. This will lead to conflict of intents as at least one I-485 is not filed in good faith. CIS may not take it lightly. So he would not suggest to apply for two I-485.
 
Yes,there is every possibilty if two 485 are filed(as theoretically
it is possible,since one for future GC),it will tend to attract
adverse CIS observation, some way) .
Considering an I140&824 will be filed for second GC(job2),(as it may be faster and he has a chance),
the quetsion basically here is--Two I 140s for the same candidate,
with different job decriptions and slaries(pl.see above message).
Will second I140(mentioning info' there in about first I140,since there is a column )
will hurt any way in the whole episode?
This is the candidate prime worry and critically affects the decision.
If hurts,he has no option except to abandon. the second one.
He will not be getting much info' from two attroneys as they were intersted in cases of their own but not throwing much light on this combined scenario and affects.
Any further thoughts and expereiences will help him to take a decision.
 
Per attorney i spoke if there is difference in the offered salary should not create any problem. He said as long as you meet the requirement for both underlying labor it is all right.

All i can say is if you can use same resume for Job A and Job B it should not create any problem. If the job descriptions are different the question would on your experience and Qualifications if you feel that you are good for both the jobs then certainly you can use. If there are no manipulations then you should not face any problems.
