Friends,
My Situation:
1.Filed Labor from Company A in Oct 2002 from NJ(RIR).
2. Got frustated by long wait
3. Changed employer filed another labor from "Fast" Maine from Company B
4. Just got labor from B with PD few months old.

Can I file 140/485 based on B labor now and file a new set of 140/485 when my labor from A Employer is approved( and join back A, A is willing ).

Both A and B are, equally bad, consulting companies. In case of B my 485 may take very long and might not be able to use AC21.

Gurus please help

Hi Gunea_Pig,

I don't know exactly what you should do in your case, but I know there is a general rule that one person should not have two pending I-485s even though CIS allows you to do that. It's not a problem to file two I-140s, but if you do concurrent filing for both companies, it would result in two pending I-485s. The major problem is that it will cause confusion to CIS when it comes to fingerprinting, name check, etc.

In your situation, people usually file I-485 for one company and choose consular processing for the other. I suggest you to consult an experienced lawyer.

so what do you folks suggest
1. File 140 and CP from B.
1.1 Wait for A labor and file 140 and 485 once there ( PB would most probably be current on this. )
2. File 140/485 from B and try take a AC21 shot( if possible and if needed).
2.1 File 140 and CP from B.

does It make some sense ? Please help.
