MTR (Motion To Re-Open) and Legal Status/Right to Work

I am currently in H1-B status which expires in January. The same employer submitted for a 3-year extension couple of months ago and the I-129 petition is still pending. If the petition gets denied and my employer files a MTR (Motion To Re-Open) what will be my legal status after my current H1-B status has expired in January and MTR is still pending? Will I be allowed to work for the same employer while the MTR is pending? Please respond! Thanks!
