MS + 2 Year Experience

Dear all..

Is it too risky to file PERM with MS + 2 years experience for a Senior Engineer Job title. It is basically a Senior Software Engineer position. The company is big with more than 1000s of employees.

No problems with filing as MS+2.

Note that you dont necessarily need to have alternative minimum requirements for the job. Just Make sure your qualifications match the primary requirements of the job (MS+2).

Read up on Kellogg's PERM denial due to alternative job requirements.
 
what would be the answer to H-12 in his case? Yes or No ? His SVP level would be more then 8 !!!

MS+2 falls in SVP Level 8 (since it is equal to 6 yrs of SVP years).

MS+0 falls in SVP Level 7 (since it is equal to 4 yrs of SVP years).

If the O*NET says SVP Level of 7 to <8 is normal for the occupation, MS+2 would require business necessity letter while MS+0 will not need business necessity letter.

Note:
BS+5 falls in SVP Level 8 (since it is equal to 7 yrs of SVP years) and it requires business necessity justification if O*NET says SVP Level of 7 to <8 is normal for the occupation.

I am trying to file PERM EB2 for Systems Administrator position from Los Angeles county in CA. The company has already done the Sunday ad which says BS + 5 years of progressive experience. The job offer is 72,000.

I have BS degree in Computer Information Systems and I have exactly 5 years of experience before joining this company in 2004. Will this be qualify for EB2?

I am all confused with Level Wage, job zone and SVP.

I am following your posts form past few days. Your answers regarding the PERM cases are very helpful.
My lawyer is almost ready to fill the ETA Form 9089. I need some advice regarding my case.

Below are Details

Job Title: Software Engineer (Level II)

EB2-- MS in Information Systems + (2yrs of experience in the job offered (or) related occupation)

I completed MS in 2001 and started working with my employer in 2001. I held a position as programmer/Analyst till March 2005 and was promoted to Sr.Software engineer. The job duties were more than 50% diffrent from thecurrent job. but the Minimum requirements were kept same for the current and previous jobs.


While filling the sections H & J of ETA Form 9089 here are my assumptions..


Section H

H6-Experience Requried--Yes
H6A --24 Months

H7-Alternate Field of study -NO

H8-Alternate Combination of education Experience -NO

H10-Experience in alternate accuption--- YES/NO ? (Please advice)
H10B--? (Please advice)

H11-- Put the entire Job Description.

H12-- Normal to the occupation-- NO (Provide Business necesssity letter.. MS+2.. SVPlevel=8)

H14-- Put in the Minimum requirements for the job offered.



Section J

J18-Alien has experience as requried --YES

J20-Alien have experience in an alternate occupation --YES/NO--? (Please advice)

You will qualify for EB-2 with BS+5 as the requirements. You will have to declare business necessity as BS+5 takes you to SVP 8 and for Systems Administrator normal SVP <8. Pay should be fine as long as you file as "Systems Administrator" and not as Engineer/Programmer.

Would be better to explain J21 somewhere if not filing electronically(pre-Perm, lawyers explain this in cover letter).

H12 answer Yes or No???

I came across post which reads as follow...

PERM Certified for MS + 2 . H 12 answer YES.

and also there are 2 group of attorneys, one answer H12 YES even though SVP level exceed to O*NET. othere answer NO and provide Business Necessity letter. Both group has same rate of success. So I believe answer to H12 has no direct connection to SVP level.
 
I did posted that MS +2 H12 YES..

My SVP exceeds 8...Still H12 was YES...

Got CERTIFIED within 1 DAY
