Dear All,
I am offered a part time consultancy to one of my clients. Right now , I am a full time with a company processing my GC. I am with EAD . No H1-B.
My question can I do second job with pay ? If yes, how the second employer will pay me ? By W2 or 1099 or by some other procedures and which one is the better way?

With EAD you can work as many jobs as you like. As it is going to be a part time job most likely the employer will give you a 1099.

If I go for 1099 , do I need to incorporate myself to bill(invoice) the company to get paid?

No Problem , its your choice , you can incorporate your own company ( C- Corp ) as S - corp needs Green Card but some folks incorporated as s corp even without green card. No body checks. But if you are just working with no other employee i would suggest you just go for independent contractor or on 1099. I am on ead , i do 40 hrs for my employer and I also have mortgage broker buz as a part time job. And all the comm. is on 1099 MISC. There is no problem.
