Moving from H1B to EAD

Hi, I recently moved from H1B to EAD. I went to India and re-entered using my Advance Parole as I had one month left with my H1B (6 Year Period). My wife also has an EAD.

My Kids are still on H4 (on I-94 Status) even though we have filed a adjustment of Status for them (I-485) too.

Question: Do we need to do anything for them or will they automatically move to adjustement of Status after the expiry of H4. What will happen to I-94 Status for them? Please guide.

Please provided any information if someone has prior experience on this.

They will be on AOS. No need to do anything until they get green cards.

Question :
Should i go ahead to apply my EAD and not extend my H-1B or, it will be better for me to renew/extend my H-1B instead?

I have asked my lawyer, they suggested me to renew / extend my H-1B instead.

Anyone, please advise me.

-----------------H1 extension is better for you But if you are working with consulting company USCIS may ask for lot of documents with RFE. If consulting company is filing H1 extension then as back up I will also apply for EAD so that if any problem in H1 extension approval then one can work with EAD.

This is not an "instead" situation. If you are able to get both an H1B extension and EAD, go ahead and get both. Each is like insurance for the other. If you have a valid H1B, you can remain in the US if your I-485 is denied (unless it is denied for a deportable reason), and you don't have to worry about gaps of employment if there are excessive delays with renewing your EAD. If you have an EAD, you can get another job quicker if you are laid off. So get BOTH.

You don't need the company to file for your EAD; you can do this on your own. And if you filed your I-485 after July 2007 and paid the all-inclusive $1010 fee, your first EAD and all EAD renewals are free.
