Hi all,

Our company was bought and I will have to move to Chicago next month as an employee of the new company. I have 3 more years left on my h-1b. I also have EAD, but still working on h-1b. Wac # 03-003-xxxxx

1. The new company is willing to do a h-1b transfer. Should I do this or use EAD. Since AC21 doesn't have clear regulations will it be better to use h-1b ? and then when my case actually is assigned at CSC should I worry about AC21?

2. What should the lawyers do with my pending 485 at CSC? Should they inform INS about the acquisition etc.?

3. My wife is also on h-1b and has a job in chicago. Would it be worth while to try starting GC process with her as primary applicant and go the Consular processing route since CSC is so slow? Would doing this somehow jeopardize out original CSC 485 application ( I am the primary applicant on this )

If there are 2 I-140's then you can file your 485 twice. Ultimately you might be asked to withdraw one. No harm in making your wife the primary applicant and you can either file at NSC or go for consular. But in the consular method you lose your AP and EAD privileges. You have to be working on your H1.
So to answer your question number 1, you have to first decide on question 3 and the outcome would help decide if you must tranfer your H1 or can work on EAD.

If you go the H1 route with your new company in chicago, I would think your application would be transferred to NSC and CSC would no longer be looking at it.

Your lawyer might advise you that you should inform CSC, and he/she would probably be right.
But there are other experts out here and we must wait and see what they have to say.
