hi,
I came to US in 1999 june with valid visa stamping up to
2001 sept. In 2000 june i changed to another company
with new H1. In 2000 dec i went to china, at POE i didn't
show new h1(as i have valid stamping from old).They gave i-94 up to sep 2001(according to old h1) . After wards
in 2001 i got stamping on my passport for new h1 at st louis.
Now i am planning to go for Cp interview in sept 2002. Now my
lawyer is going to extend my h1 also , he is telling that i have to get correction i-94 before that.he told he will send to local INS. Is it necessary to get correction for i-94 .
If so how many days it will take average. I want to know whether INS will do that correction.
please help.

You MIGHT have been out of status since Sep 2001, since the last I-94 that you receive overrides any previous I-94s. In your case, even though you might have had an I-94 which came with your new H1, the I-94 you got at the POE was the latest one. Might be best to try and get it corrected if you can. I saw links to some discussions in other forums about people getting their I-94 corrected. You can try and search through this site. Do a search for "Aytes".

Can you tell me from your approval notice if it was filed as an extension or as new H1 B?
I also switched employer but the H1 filing was done as an extension.And the approval notice said that my extension of stay was approved.

yesterday. today i checked my mail and failure
notification came so i am posting here.

I am writing my whole situation.

I came to U.S in 1999 june with visa stamping valid
up to 2001 sept through company A. In 2000 june i
changed to company B through new H1 valid up to
2002 dec. In 2000 dec i went to china ,at POE
i did not show my new H1 ,they gave I-94 up to
sep 2001. I don't know about I-94 validity stuff
so i didn't care much at that time.In 2001 aug i
got my revalidation for new H1. Now my lawyer
want to extend my h1 , so he told to send all
information(i.e i-94..).Then he told that i have
to get corrected my I-94, so he told me to send
passport with i-94.I send to lawyer on friday
and today he told that he got corrected.So i
don't know much about procedure.
