Back in 1999, my older sister, who is US citizen filed for my mother's immigration. After she filed her case, she got upset with the whole family and was not in touch with anyone until now.
Meanwhile, I came here on H1-B in 1999. My mom's brother (US citizen) helped my mom to get visitors visa in May 2000. Since then, my mom visits us and goes back before her I-94 expires. Her visit visa expired on May 19, 2005. Her I-94 is expiring on October 9, 2005. She is with me these days and plans to leave by end of September to go Canada with my other sister there.
Now my US citizen sister finally got in touch with my other sister and showed intention of persuing about my mom's immigration. She gave us the reciept # for petition. I checked the status on INS website and my mom's case was approved on February 17, 1999.
Now my sister is willing to help my mom get her green card either on old petition or if needed, she can file a new petition.
Online status for this case number is like "This case has been approved. On February 17, 1999, an approval notice was mailed....".
My mom was in India when the petition was filed., so I guess she was suppose to go to embassy in India to get her green card. Now as she is already in USA, can she still get benefit of her already approved case?
This is the whole picture today. Can someone advice where does my mom's case stand today? Can she go to consulate here and get her green card stamped based on this approved petition? Or my sister should file a new petition? If she files a new petition now, can my mother stay here legally after her I-94 expires?
We do not have any approval letter with us. We will need to get that from INS.
