Mortgage Pre Approval, Immigration Status?

Hi,
I am in the process of getting a mortgage pre approval and I am supposed to provide documentation of mine and my spouse's immigration status. I have H1 (7th year) but my wife is on EAD. Her H1 expired in May 2004. We have given a copy of the EAD to the underwriter, but they are unable to understand the concept of EAD.

Has anyone in similar status bought a house? If yes, what documentaion did you provide for immigration status?

Would giving a copy of her I-485 receipt notice work?

From my experience it depends on the bank, even in some cases on the person you are dealing with. Some require nothing less than a green card. Others require documentation of status for a couple of years in the future (H1, EAD...). I provided even less: an H1B (6 months before expiration) and a copy of my I485 notice of action.

I just gave the photocopy of my EAD card.

Try getting a letter from Employer that your Green Card is in process or will be processed by the company. It worked for me two years ago when I was in my 4th year of H1. I didn't start the GC process by then.

Some mortage guys take anything and some are very picky.

If that doesn't work, take your great credit score, and find another lender who wants your money. Don't stick around if they try to raise your interest rate just because you don;t have a green card.

There is no law that requires lenders to ask for immigration status. Its really only the lender who will lose your business. My lender never even asked for my immigration status, and I got a great rate based soley on my credit score/history, and income / employment history. The first set of questions I ask a lender before agreeing to give them my business was about their immigration requirements.
