Moribund I-485 Application..Plse help

Married July, 05

Filed all docs and with a receipt notice of Nov 25 05.

Spouse got notification for Biometrics in Feb 06. Completed all that.
EAD didn't arrive until June 06. Had to call them several times before it came in.

Went for interview on August 3, 2006. Baltimore.

Interview went pretty well I think. Weren't separated, just the general questions about how we meet and proof of relationship. We had some of those and some pics as well.

One thing though, we didn't have our 2005 Tax returns with us and I saw the officer make a note of it.

He said the interview was over and asked us to leave, and when I inquired if that meant my wife had a green card..all he said I was we will receive notification in the mail and to follow instructions.

That is it! And I mean it's being almost 9 monthns now and not a single word.

All calls to the cutsomer support desk reveals no additional info.

Anybody being in this situation before?

Any insights you share will be greatly appreciated.

Have you made an infopass appointment to go enquire about the status of your case? The USCIS hotline is useless, if you really want to know about your case, make the infopass at the office you were interviewed at and ask them.

Also what does your online status say.

At a guess you are stuck in FBI namecheck.
 
I haven't scheduled an Info Pass, as I was of the understanding that they wouldn't have any info beyond what the officer gave me when I called customer service.

I recall signing up for online notifications via email but I don't know the site/link to check the status online. Could you please provide that?

Is FBI name check different from investigation (as someone also suggested that)..

This is not true. The people on the customer service line often have very little information. Your best bet is always to make an Infopass appointment. I suggest you do so.

Checked online status and it says "interview conducted and under active review by an officer"...anybody knows what the heck that means????
 
Probably means that you interview was conducted and is being actively reviewed by a supervisor/officer before it is approved/denied/called for stokes interview.

Geez, why will they???when it looked like the first one went pretty smoothly...I actually thought I was going to receive a mail from the officer requesting the 05 Tax returns...but alas!

I guess you can never tell with these folks...

Nobody is saying you're going to get a Stokes interview Samoa. Praetorian XI was just using it as an example of one of the things that can happen.

:) I also married in July 05 but I filed for AOS 3 months earlier than you did.

Well, anywayz... when you had the interview, did the officer tell you if the name check was pending? (That's what happened to me when I had the interview so I didn't get approved right away) You may send a letter to FBI and ask for your current name check status. This would take months or forever to get a reply but still it's worth trying. Do you have a very common name? If you do, it might be the reason why it is taking so long for the name check clearance.

And did you send back the tax return right after the interview? Did you make sure that the officer received it? Similar situation happened to me too - my attorney FORGOT to notorize our I-864 form and the officer wanted him to send it back within the same day. It took me approximately 3 1/2 weeks to get my AOS approved after the interview.

By the way, good luck! And think about the good side ==> if your application gets approved after July, you're getting the 10 year GC and not bothering about whole I-751 crap. :D

I want to thank and each and everyone of you for your input and replies thus far. Very much appreciated!

There was no mention of name checking at the interview, he never specifically asked for the tax returns, he was pretty much bland if I may put it that way, all he said was to follow instructions when we received the mail. And that mail is yet to come!

Also, I must say my wife has a rather common name - too common - both first and last names.

My attorney has suggested that we send them more docs solidifying proof of our marraige (including the tax returns). And we are going to do that.

He has also scheduled an info pass on our behalf since work and other commitments wouldn't allow us to personally do that.

Anyway, I will remain optimistic, keep praying and hope for the best outcome.

Second Interview

Folks,

I finally scheduled an Info Pass at my local office and was told a second interview will be scheduled for us. I guess it is a stokes interview!! Darn it!

Anyway, the officer said a date for the interview is yet to be determined, but, I 'd like to be as prepared as possible.
