Hi,

I was previously on h1b (with an undergrad degree) for 0.5 years. I am now back to school for a master degree on an F1 visa. I am planning to graduate Dec 07 and by that time, I will only be in F1 status for 6 months, so I will not be eligible for OPT. I would like to go back to H1b after graduation:

1. Can I stay in the US for 60 days after graduation before my new H1b status kicks in?

2. According to previous postings in the forum, I believe that I am not subject to the quota. But if I plan to start work as soon as possible after graduation (Dec 07), when do I need to start applying for the new H1b visa? (How long is the processing time?)

3. Is this considered as a H1b transfer? Is there a website where I can read about the procedures and documents needed?

Sorry i dont have an answer to your Q however, seems like you might have an answer to my question.

I am an MBA student currently on F1 visa. I have stayed in US on H1B for 3 years from 2003 thru 2006.

I got my current F1 visa from India where my previous H1B was cancelled without prejudice.

My Question:
When my employer files for my H1B again, do i fall under the H1B subject cap of 20000.

if you are on H1B and have not exhausted your maximum allowable period of admission, you can get back on H1B and will not be subject to the cap. see attached memo
