I am responding to your facsimile inquiry received October 12, 2006, concerning the name check status of Mr. <Bushmaster> for immigration purposes.



A review of the Federal Bureau of Investigation's (FBI's) Name Check Program database concerning this individual revealed that three requests were received from the United States Citizenship and Immigration Services. The submissions were received on July 31, 2003, September 13, 2004, and October 15, 2005, respectively. All three submissions are currently in a pending status.



The FBI is sensitive to the impact of the delays in processing name check requests. At the same time, the consequence of the FBI's mission on homeland security requires that our name check process be primarily focused on an accurate and thorough result. While an exact date for completion of this review cannot be given, please be assured that the results will be made available to the immigration authorities as quickly as possible.

Bushmaster, you are probably really frustrated with this. I am on a similar boat waiting for my name check to clear. The whole thing is just confusing, like why the NOA date is different from the online date. I'm just tired of calling the NCS to talk to rude representatives that know nothing about the system they are working for. Can't wait to be done with the whole process.

Are you an army pilot? Don't you need a security clearance to be one?
 
No gordi, I am an Apache technician, no security clearance is required however they check our backround through DoD and we treat our job as we are holding security clearance. Would like to go to flight school however I can not because I am NOT a citizen. I am also a civilian pilot.
 
It doesn't matter if someone has been thru all kinds of background checks in the past and present for whatever reason/purpose because USCIS needs to do a full background check each time whenever someone seeks an immigration benefit with them, which is pursuant to law adopted in 2002. Thus, it doesn't matter if someone was cleared previously without any hitch, because if that person would file an application with USCIS for immigration benefit, s/he must need to have a full clearance on throughly background check.

Bushmaster, by reading the text of your letter that you posted here, there is no doubt left in my mind that you are stuck in 'Name Check' game. Involving the Congresspersons is good to get the answer from USCIS on the status of your case, but Congresspersons cannot do anything to get you out of 'Name Check' game, believe me.

You should put pressure on USCIS/FBI thru your Military officers to get the clearance soon especially when you might be deployed to Iraq. If this doesn't work, then the ONLY couse of action which is the best one is-sue the USCIS in the court for not making a decision in your case within 120 days of your interview. USCIS has a written and firm policy to expedite the background checks on a plaintiff whenever a lawsuit is filed against them by the plaintiff.

You don't need to be scared of anything or something that happened in the past, because USCIS must have already used it against you to deport you if that was so compromising.

And no, I wasn't in this journey; rather I used to post on other immigration forums as an advocate of immigration laws and how USCIS works. And that's how I know you, and I had answered to your questions many times in the past on different immigration forums.
