Moonlighting during NIW.....hardon ur input

can any one please answer this questionfor me that when can one officially start moonlighting if on aJ1 waiver and currentlyhas just completed 2 yrs at MUA?I have an EAD through NIW....If one moonlights then does he jeopardise his H1 status or NIW? please explain (clearly)all the gurus and hardon your input is required

YES (for the H1 status)
No (for the NIW)

If you moonlight using your NIW related EAD during the initial 3 years of the actual J1 waiver, you loose you H1b status and change your status to 'adjustee'. The law (or at least USCIS interpretation of it) says that you have to serve the 3 year period 'in H1b status'. So, by moonlighting on EAD, while you still have a valid 'adjustee' status you blew the conditions of your waiver. If USCIS finds out about it (by reviewing your tax records at the time of an I485 adjudication), they can invalidate your waiver and make you start all over again.

You will have to do it some other way:

- you can get a second H1b from the moonlighting employer for a part-time job. As long as you practice 'full-time' (36 hours) for your main employer, the conditions of your waiver are fulfilled and everything is legit. Problem with that is that while your primary H1b is cap exempt, your moonlight H1b is not (unless you worked for a non-profit or educational institution). Also, an H1b is expensive.

- find an agreement with your primary employer to run your moonlighting income through your primary employers books (and onto your W2). Tax wise, it shouldn't make a big difference (bc you would have to pay self-employment taxes on a 1099 independent contractor income anyway). Now, employers might not have the accounting flexibility to do this. Key would be to find a way to loop all the money through to you after deduction of taxes (but without employer overhead). Also, your primary employer might not be interested to expose himself to any liability related to your moonlighting gigs.


Coming back to your original question:

3 years and 1 day after you started your J1 waiver employment on a H1b visa, you can use your EAD to moonlight.

At that point, as long as you provide primary care services at the hpsa/mua locations stated in your NIW on a full-time basis, you can do whatever you please in your free time. If your moonlighting gigs are in a hpsa/mua, you can add them to your petition as additional practice locations and count the time towards your service requirement.

ie if I moonlight after 3yrs and 1 day I can fulfill my waiver in less than 5yrs??thanks in advance for your anticipated reply :D
 
It won't be faster.

But lets say you can make $100/hour at your regular job, but $180/hour at your moonlighting gig. Wouldn't you want to work more at the moonlighting job than at your regular job ? Lets say you started working 20hours/week at your moonlight job, you would have to cut back at your main job to something like 3 days/week.
A. your employer might not like it
B. once you have to bring evidence that you worked 'full time' at your NIW practice location, you might have some people rat you out to USCIS saying that you only worked there 3 days/week.

If you add your moonlighting location to your NIW (if it is HPSA/MUA), you can count all the time spent there into your 'full-time' committment.

I want to get in touch with him to sort out money matters. He has spoiled my credit scores. I can't even get a rental apartment NOW !!

but when I called these phone numbers and fax number, they don't exist.(As expected !)
I don't think he has web site either.
Any more information so that I can get in touch with him to payoff and get my credit history straightened which will give me chance to rent an apartment
I have 23 days to vacate this present apartment !(forget about buying house with present status for me ! Ha, Ha, Ha, Nice Dream I had !! )
 
At this point I will try the credit agencies and try to fix it through them. If they can't find him either you might be able to win your case.

He was a head hunter for J1s, if that clarifies it. One of those services that charge you upfront because they have a great job for you and then they say that one didn't work, I will find you another. I guess he has placed some people, probably merely by responding to ads. The rest of the story is up to you to decide!
