My I-140 was filed by my company lawyer with all supporting documents and with the subject line for EB2 category but he mistakenly checked the wrong box on column 1 (petition filed for). Now it was approved for EB3 and my lawyer again overlooked that and considering it is as EB2 approval, he filed I-485 application. I-485 is now rejected for obvious reason saying EB3 is not current.
My lawyer says he needs to contact NVC to have I-140 papers back with Vermont center. Any idea from anyone what steps must be taken now and how long it may take?
