missing medical with I485

I filed my I485 concurrent on Sept 30, 2005 in order to beat the initial EB1 retrogression. As a result I was unable to send out my and my spouse's medicals with I485.

I guess we will get RFE for that. Our medicals have been ready since October 2005. Should I ask my company lawyers to send out the medicals as a pre-emptive measure before the RFE is issued?

Do you think USCIS will be able to insert the medicals in my file, given that we will send them copy of I485 receipt notice?

What do you guys think? I am just hoping to not lose precious time

So you are really married ;)

Has your I-140 been approved? I think the medical report is not valied after 1 yr. You probably need to get a new report.

Yes I140 is approved. It sux that I have to do medical again.

But the question is should I send medical in advance before the RFE is issued? Will that confuse USCIS?

I had the same case. But, in my case I did not get the medicals at all when I was filing the petitions (140 and 485). I filed both on Sept 29th 05.

You just need to wait till they send you a RFE. At that time, you will probably need to go and get medicals one more time and reply to the RFE. At the same time, they will also ask for any other documents they may need, like for me they asked for documents with birth details and parentage.

If your 140 has already been approved and fingerprinting done, then you should get the RFE very soon.

I am also hoping that I get my RFE soon. My I140 was approved on August 11, 2006. My FPs were completed in Feb.

eb1orGC - what was your timeline for I140 and I485 approvals? Were there any LUDS in between I140 and I485 approvals?
