Hi,
I have one of the original petition papers & copies of all the other papers. My company have misplaced my I-797 (original approvalpaper addressed to the attorneys). In this regard I wish to know on the following details

1. How long will it take to get a duplicate I-797

2. Will there be any fee/cost involved if applied for aduplicate

3. Is it possible to take an appointment for visa without the original approval paper addressed to the attorneys and with all other documents in hand?

Thanks
JK

Same situation

I am in exactly the same boat...damn DHL guy misplaced the document. I know we need I-824 to file for duplicate but I have read in places that it can take upto 2 years to get that done...I simply cannot wait for 2 years to get the I-797 and go to india....

But I am not sure if it will really take 2 years..I need to find out if somebody got it quicker and if so what is the timeline I can expect it to reach here in??

Also need to know if the I-797 duplicate will work to get stamping in Mexcio consulate.(Ciduad Juarez). My appointment is on 23rd Jan 2007.

I-824 processing times

According to uscis.gov, all 4 service centers are processing I-824 in six months or less. Whether one wants to rely on those "times" is a different story.

Darn it!

Thanks triple citizen. It feels atleast a little better that it will take approx 6 months to get duplicate copy.I've read at other places that it could take upto 1 year--now that will drive me absolutely crazy..........having not seen family for the past 2 1/2 years...i guess i have to wait friggin 1/2 year more :(

Stuck "inside" the US

I feel for you, and others who get "stuck" inside the country for reasons beyond their control. When I came to the US on a K-1 (which is a single entry) on 11/22/02, I knew that until I successfuly complete my AOS or acquire an AP, I cannot visit my folks in Canada. I was lucky that Boston at that time issued same day APs. I applied for AOS on 11/26/02 and had an AP 4 days after entering the US. However during that 4 day period, the feeling of being locked in wasn't very comfortable. I got lucky and it lasted only 4 days. I have read/heard of others being locked in for years. I admire their patience!!!
