Called IIO today at 11:30am, she said there is an RFE generated for this case. I would receive that in 2 weeks

Let me give some insight about my case.
Applied 485 in oct 2001 (RD 10/04) (ND 11/23)
Got married and applied for my wife in March 2002
Left my sponsoring company and joined another company in July 2002. Even though i am safe with the AC21 portability issue, right now i am working as hourly paid W-2 contractor.

I am not sure whether i can get a continued employment letter from this company, if INS requries that.

Please post u r suggestions/thoughts

Well you could possibly have two situations.

An RFE for ur marraige certficate or related to spouse.
else
An RFE for paystubs etc.

But in any case , there is no point in getting worried about it when you don't know it yet.

Better yet, get all your documents in place and be prepared .

if the RFE is for marriage, did INS sent that for my wife, rather than mine, because when i filed i didn't add any spouse name.
also, i have heard that INS process both cases separately, if they are filed separately

First of all you should be glad that ur case has been already been processed and INS will give decisions (within 2 weeks) once u send RFEs response to them.

INS issues RFE sometimes in random basis for quality control pruposes, so do not worry. Get ur RFE notice first in mail and reply them what they have asked.

If the RFE is for employment letter/Paystubs/W2 then you will be proivding it from ur new employer as you are using AC21 regulations and INS cannot deny that.

There is a logic behind issuing a EAD before GC is issued and INS are very much aware of jobs change under this weaking economy and massive layoffs. Applicants are free to change jobs after 180 days provided the job duties matches (100% match not neccessary) with your labor applications.

I will suggest you to get ready with all your paper work and send them ASAP once u receive notice in mail.

you better hope that this is not for pay stubs etc, cause Heaven forbid, if you do not make as much as was stated on your labor cert, you could have issues to deal with. W2 hourly is good as long as you have a project, if you come to the bench and have had months in the past 6 months where you've not made as much as you should have as per the labor cert.......who knows.

I dont have issue in the pay, because i am making more than 75% what is mentioned in the labor certificate.
Only issue is the W2 company what i am working is a big one, and they won't give any letter kind of thing for continued employment blah, blah., because if i have project they will keep me and i am pretty sure i will be out of this company if my project gets over

at least your case has been reviewed and be approved soon. Mine still not been assigned.

The only thing I want to say is my best wishes. Seems INS has touched Oct. first-week club members. Let's cross our finger.

When is your last talking with IIO and what he said?

I talked to her today, she said it will take atleast 1 to 2 weeks to get the RFE typed and sent that to me.
Right now they are typing RFE's for people who got that on Nov 3rd.
She was little bit cooperative though, just like others she said that she can't get the info what exactly it is for

Sorry for being the bearer of bad news but the 2 week approval is not really true. I guess there is a big luck factor involved as well. Some ppl get approved in 2 weeks and some ppl like me are still waiting after 2+ mnths.
Rfe rcvd by Ins : 08/20 and I am still waiting. Rfe was for paystubs, tax returns and employment letter.

I read one of the posts few days ago where a guy had sent RFE response in Feb and was appoved in Oct.

So sit tight , cross yr fingers and hope for the best.
