Misdemeanor/Summary Offence and visiting as a tourist

Hi,

I studied on a j-1 student visa at penn state last year, while there I recieved a disorderly conduct citation as well as an underage (both in the same night, something I regret to this day. Bad, stupid decisions on my part). I've checked and the underage is a summary, while the disorderly is a misdemeanor

I have a girlfriend in the US, and will be visiting her in early november and late december. Will these prevent my visiting her in any way? Should they be declared on the visa form?

Are you applying for a B2 visa?

Well if the visa form asking you for issues with the police/law...then you should stated anyway...it's better to declare it than they found it by their own means. That can be worst.
 
I've actually posted this in the wrong bit - I'll be entering the US as a tourist on a visa waiver.

I recieved disorderly conduct and an underage citation in the form of a fine. It does say if you have a criminal record you may be refused a visa waiver- I was worried that these would stop me gaining a visa waiver (the form you fill in on the plane), so I spent this afternoon looking up

Now, I looked up the form and it asks this:

"Have you ever been arrested or convicted for an offence or crime involving moral turpitude or a violation related to a controlled substance; or been arrested or convicted for two or more offences for which the aggregate sentence to confinement was five years or more; or been a controlled substance trafficker; or are you seeking entry to engage in criminal or immoral activities?"

My fines didn't add up to five years sentence and I haven't had violation of a controlled substance as those are drugs. The bit I was worried about was the 'moral turpitude' piece. Now I looked this up online and found the US department of state foreign affairs manual.

If you look on the top of page 5, it lists the crimes which are NOT of moral turpitude - this involves liquor violations and disorderly conduct. This is in terms of a visa issuance. So - going by these facts, I answer no to the question on the visa waiver form - meaning I'm allowed a visa waiver.

Am I right?

If you were arrested and charged then I think you will need a visa.


My advise would be to apply for a B visa, and come clean with what has happened.

I wasn't arrested, only fined.

Does that count? I have only 33 days til I gotta go and see my gf.. I really don't think that's long enough to get a visa? :(
