Okay! I found out what an LCA is but my question now is "how will I know what the prevailing wage is for almost the same kind of position in my geographical area?". Is there a database that gives this info?
Okay! I am completely confused with this issue. Let me explain my situation clearly.
I just graduated with a MS in Computer Science and I am on my OPT right now. A company wants to hire me here and the employer is also ready to sponsor H-1B visa but the main point is that he wants to pay me a very meagre amount. He offered around 27-30K only. Right now in this geographical area, for the same position the salary rate is around 40K-50K. What I understand about the DOL and LCA stuff is that the employer has to pay me the rate that is currenlty applicable in the geographic area. Now the questions are:
1) Can this employer sponsor my H-1B with the 27-30K pay? He is saying that he can. Is that even legal?
2) I somehow want to convince this person to offer me a little more pay. I have a feeling that he wants to take advantage of me. I want to use the H-1B reason as an excuse. Any pointers?
I hope I am being clear here and wish to recieve some response.
Its illegal on employers part to pay less than the prevailing wage in your area. USCIS might raise an objection when H1 application is sent for approval.
