Might be getting NEW TN soon...Yaaaayyyy!!!

So I got affected by the sub-prime mess, got laid off, but might be starting a new job with a telecom on Apr 28th.

Can someone see any issues with my plan below, and correct where appropriate?

1.) Fly to Toronto ALONE for the TN. (will INS question where wifey is?...we are on B2 pending...thanks to Nelsona's advice)

2.) Return with my TN, and immediately file an EXPEDITED TD application (the reason is we need to respond to DV lotto First Notification Letter asap)

3.) Once TD approval response arrives, we file DV lotto response for our GC chance in Aug-Sept,08


There are 2 reasons why going alone seems viable

1.) Flights+accomodation for 2 adults & 2 toddlers is more than the $1000 expedited fee
2.) Wifey's TD approval requires Consular appointment, which will eat into our DV lotto response timeline, and still costs $150

Does this make sense? correct me where I am wrong...Thanks:)

If it weren't for the DV, I would not expedite.

Even with DV, is there some pressing need to get approved? You are in status now, ans family will be as soon as I-539 is submitted.

Nelsona, is your question in reference to wifey's TD?

If so, then yes, there is a need to switch to TD...at least in my thinking.

When we applied for B2, I put wifey down in the same I-539, with me being the principal applicant. Once I get the TN, I plan to withdraw the I-539 (for B2) visa, since I do not want it to re-appear at a later date, after meandering in the INS system, switching me to B2 from TN.

My thoughts are that B2 withdrawal request will cance wifeys B2 too, and as such, I want to ensure that she is never "out of status" at any given time, by filing her TD request.

So the key question is should I expedite her TD or not...

Where did you get "don't file TD" out of that?

They will be in TD status the insatnt they file. Why pay $1000?
 
... and technically, since they are still entitled to the B2 as long as they remain in US (up to the date they get on their B2), the need to file TD is questionable.

But, as I already advised, I would file regular I-539 for TDs soon after getting TN.
