Memo addressing compnay name change cases

Friends let us not lose hope but again start calling INS HQ and request them to send
memo to address company name change cases. Remember they had initially mentioned
addressing this issue by march end, then april 15, then may 15 and now they are saying
june. If we remain silent then it could get delayed till june 2002 if not later.

PL start calling INS HQ again

Yes buddy, that is the sacred duty after praying to god for us. The legal deptt of my company says it will be two more weeks before the memo is received at the centers. God knows what is true !

Let us not overlook the probability(or fact?) that these guidelines/memo may just mention about H1-B extensions and nothing about pending I-485 Company Name Change cases.

So far, VSC/INS HQ have maintained that the guidelines will be issued about Company Name Change cases but from the news article above it seems they are not going to do that.

I think most us talked to or sent letters to various Senators about this issue. I think we need to be more specific about our particular situation, which is company name change issues.

I think that the memo will address compasny name changes in June. It is going to take much longer for INS to come out with the regulations for portablility and company name changes.

Till then, we are stuck to our present employers!!!!

First and foremost let me thank all 3 of you for contributing to this thread. We all
nead each other for moral support. Someone had mentioned some time back "what
sin have we comitted that vsc had decided to put our cases on hold just because
our companies changed their names" Now we all know that VSC had decided to put company name change
cases on hold without issuing rfe for 140 redo in anticipation of the new guidelines. I cannot understand how they could continue this hold for more than a few weeks. If this
is the case everyone was better off with the rfe for 140 redo. No one has benefitted from this crazy decision. Definitely not the 485 filers , nor most of the companies since many started filing amended 140 without rfe when this hold started. Just bad management from VSC. So we need to keep calling INS HQ to request them to stop this unjust and unfair hold

I think filing a proactive I-140 redo may be a better option, we have nothing to loose by doing so. But, again that is not a guaranteed option as we have seen that many guys are still waiting even after filing proactive I-140 redo also some employers/attorney are in favor of filing a proactive I-140.

As we all know VSC is not consistent in approving cases. We have seen, on this message board, some company name change cases (I-140 & I-485 with different company names) getting approved. I know about one case first hand (a friend of mine).

    Is this hold problem only with VSC? How are the other SCs acting on this? If only VSC act like this, we should pull VSC to the court.

It is beyond my comprehension why VSC put all our case on hold awaiting the AC21 guidelines. All of us filed I-485 much before the AC21 was passed by congress and AC21 has got nothing to do with company name changes. I think VSC should go by the existing regulations to deal with the company name changes until AC21 guidelines are issued. By putting our cases on hold and not issuing RFEs, VSC reducing work for it-self. I am not sure if VSC can legally put our cases on hold.

To sum it up, our applications are on hold for regulations that may never come.Guys, how many are ready to take VSCto court. Atleast I know that CSC is approving name change cases after I-140 redo RFE. different centers cannot have different rules.

Just my 2 cents worth . Legal proceeding by their very nature generally take a
considerable amount of time (many months) but by the very same token these
guidelines ( as far as we are concerned addressing company name change cases)
may also take many months to come out. But our request is simple. Remove the hold
and pl process these cases like they were doing so before. I have a feeling if we all
continously try to call all the officials who can influence policy and request them to
address this issue it may get taken care off sooner than later. Every call counts towards the resolution of this problem. We should request our local Senators (in person or by telephone) to pursue this matter with the Attorney General (INS is part of the justice dept) in the interest of fairness to everyone in this GC process

The article talks specifically about the H1 cases only. Does not talk about the company name change.
Maybe there is a different memo which will address company name change issue. Shailesh Gala was told by some official that there will be a memo issued to all District offices regarding this. Till now all the information coming out of HQ ( of all the places ) has been unreliable regarding this issue. I have not been able to find anything about these regs. on the INS website. INS makes statements/comments about new laws. They also post information the current regs. which are being worked on. So far I have not seen any official version of these comments or that INS is working on these regs. or memo anywhere on its site. First we need to get them to post something about this on their website. Until such an official statement is made publicly everything that anyone says about this issue is just his/her interpretation.

They will publish official version only if they are planning to come out with one in near future. But no official interpretation seem to be on the planning horizon. INS delayed Healthcare 485 regulations for 2 years and came out with one only after AILA sued them.

Unless we take proactive action nothing will happen to our cases. We will still be waiting here debating what to do when persons from our own comapnies who filed I-140 later with correct Company name walk away with their approvals.

The cazy thing is even I-140 redo will not unfreeze our application as per some IIOs atleast. I am sincerely hoping to see some approvals atleast from first batch of I-140 redos without RFE.

Folks, the INS web site has a section where they request feedback. I have typed in my remarks requesting them to provide info regarding AC21 regulations.At the very least we should request the contents of the memo which would address compnay name change etc.
I request all of you affected by this to post your concerns there (also mention the conflicting answers which we get from VSC and INS HQ on this issue) They have mentioned that every feedback comment made there will be read. Its another venue
where we can raise our concerns. We never know what will make the difference but there is no harm trying.

vsc_on_hold a few weeks back I remember seeing a post by you where you mentioned that you could talk to someone in INS HQ who mentioned that the company name change cases would be addressed in some guidelines which would be sent out May 15. How I wish that info which that INS official had given was true. Well like I mentioned before we should not give up and continue trying.

         I have written to Mr Rajiv Khanna regarding this problem and requested for help if he can. I have also mentioned about him representing us and talking to VSC or INS HQ and taking up our case. Lets see !!

        I wanted to know from our Mastech/IGATE friends as to how id their company file a redo - I140 when they did not receive a notification against their I -485 . Is it that they file the I -140 and then try to call up INS and request them to treat it as a amended I -140. Just wanted to know because I am pressurising my company to file another I - 140 for me.

Friends, there is a Policy Directives and Federal Registry dept, at INS HQ. I have been trying, but not able to talk to anyone out there. I think if we try to call them and talk to someone in charge of this Policy directives we may be able to find out what the memo or the regs. contain and when these will be out. I request all to call and also request to take the name of the person, his/her designation as well, so we can atleast start maintaining a log of what was said, by whom and when. This might be useful in the coming weeks and near future as we explore and implement the other \'options\' which have been discussed. I hope we dont have to.
